Sure they should be punished, but a murder charge?
The principle here is joint enterprise. They attended and chose to engage in a shootout that they knew could cause a fatality. They fired weapons with every intent of killing someone. All those present did.
Someone did get killed. Who got killed was a matter essentially of chance. Therefore all are guilty of murder.
As the judge said; you wilfully take part in a gunfight on the streets of north London, you have to accept responsibility for the deaths of those killed in said gunfight.
Their slain mate might have been known as billy the kid but this isn’t the Wild West. Not quite yet anyway, we are getting there..
