The UK won’t initiate A16. All it would do is lead to more talks, albeit with more supervision. If the UK is found of improperly using of A16 or in breach of the withdrawal agreement, the EU could turn to the dispute settlement mechanism which includes an arbitration channel. If such a breach occurred, the EU can legally suspend parts of the WA and TCA. The EU could introduce unilateral measures of their own to cover the interim.

The real wildcard regarding NI is the US. NI is one of the very few issues that has bipartisan commitment and support. And if that should happen, what could the UK do?
