It is legal for anyone to use any bathroom regardless of gender. There is no law or rule that says someone must use a bathroom marked with a certain sigil.
If someone wants to argue for that, thats something seperate, and bad luck enforcing it.

There are tampons bins in the mens toilets, and no one cares. I remember a dude (ok me) having his nails painted in a McDonalds at 7am, and just no one gave a shit.
