Hi there,
I bought an Xbox Series X second hand a month ago from Ricardo, the original purchaser bought it from Digitec 10 months ago, it is still under warranty.
The machine stopped working and I’m trying to make a warranty claim but they are telling me that only the original purchaser is able to make the claim, despite me being the legal owner and having the purchase receipt physically sitting on my desk in front of me.
This seems pretty bonkers to me as I would have assumed that the warranty applies to a product and not a person. That product needs repair and I, as the legal owner, would like to have it repaired under said warranty.
Here is the reasoning they gave:
>The reason why I am not at liberty to endorse warranty at this position is due to safety precautions, as warranty claims include disclosing personal data of customer to you, which represents potential legal liability that I must refrain from. I would like to thank you for your understanding.
Does anyone have any experience here? I’ve scrolled forums, the Digitec general terms & conditions and [admin.ch](https://admin.ch) but have not found anything stating that I am not entitled to make a claim, only that the product is under warranty.

From a german article:
Legally, it is quite clear that the seller is liable for the warranty (or guarantee). Nowhere in the law does it say that he owes this service only to the first buyer.
and the article:

you should be fine imo

I recently bought an expensive piece of electronics new that has a “no warranty transfer” clearly stated in the AGB. Does your state that?
What I bought has a high resale value and are snatched up quickly on Ricardo, etc really quickly. The unofficial workaround in case someone has to utilize the warranty is that the original owner does it for the new owner. The company even knows this is what happens and unofficially allows it, so it’s all very dumb. But is that a possibility for you to contact the original owners?
It would make sense that the seller took care of the warranty thing, since it’s part of the package he sold you.

I bought a used Camera 2nd hand earlier this year, the documentation included the original warranty certificate, issued by M-Electronics. This summer it stopped working. I brought it to the local M-Electronics shop and they had no issue honoring the warranty and sending it in for repairs. They did not even verify if I was the original buyer.
I can see that this may be different with Digitec, as their IT system registers the warranty together with the customer information. But they should be able to transfer the warranty. I do not see why this required the explicit agreement of the original buyer.
thats horseshit, iv bought many expensive things over the years from digitec, sold it and always sent the receipt/order info with it, i know of at least 2 GPUs that got RMA’ed back to digitec after i sold it. Iv also warrantied 1 gpu i bought from someone on facebook market place, just needed to give them order number and send it in. no issues ever with digitec
your best option is just go through your ricardo purchases and get the sellers info and give them a call, im sure they wouldnt mind emailing digitec and straighten it out
Well tu be honest a good portion of the contents is obscene, I don’t even think they can sell it to you, it’s got a games where you murder children at a campground, it’s causes fear and heart racing. I don’t even think the thing is safe it’s got electricity coming from it, and they’ve been non that they start fires, plus the static electricity can build up and jump from the “ finger” completing a circuit, they tried to kill us with the red pajamas too. No joke it’s horrifying. Have to put gloves on to turn the lights on, and they say candles is not safe, at least I can run and try and put it out, god damnit I ain’t jumping jack flash fast.
Plus it’s an x Bo x so it’s definitely no good. X is death an solve for it. It’s a horrible letter.
