Solicitor probably charging 200 quid an hour for legal advice and says “fuck it just tear it up, be grand”.
Can the solicitor be sued for the error?
Or at least liable for the costs error for the bad advice?
From the article, the Solicitor made a very rudimentary fuck up. Surely they should be barred from handling wills because they don’t know what they are doing.
Why isn’t the Solicitor being named and shamed in the article?
Damn, expensive fucking mistake and definitely not a good look for that solicitor. That’s their professional reputation well and truly shot.
And the remaining beneficiaries can sue the solicitor for the €250k his mistake cost them, yes?
I cannot understand how you could make this mistake as a qualified solicitor. A new will revoking the old one is 101.
The farmer did not intend to die without a will (intestate) and so the only thing the court could do was reinstate the intentions of the deceased by bringing back the only existing will which was the 2015 one.
Pure madness on the part of this solicitor.
If the 2015 will was destroyed, how do they know the contents of the 2015 will?
“I could print out a copy of the 2012 will and have you sign it with today’s date…. But shur fuck it, just rip up the new one, it’ll be grand. Pub?”
Jaysus, a high court judgment costs would take a nice chunk out of that 250k estate too. If I were them I’d be considering suing the solicitor.
All that for a €50,000 share. I wouldnt mind but Ms H won’t see the colour of it after CGT and costs. I wouldnt be taking money that someone didn’t want me having, I’d feel its bad money – ill gotten, ill gone. Costly costly business contesting Wills, they’ll be lucky if there’s much left by the time the costs are paid.
