Britain drops demand for removal of ECJ role from NI protocol

  1. headline doesn’t match the story

    > A UK government spokesperson told The Irish Times later that “any durable solution must address the full range of difficulties created by the protocol, including on the European Court of Justice.”

  2. So does this mean that the ECJ isn’t this evil organization that hates Britain and want’s to destroy the Union?

I do like how the ECJ went from “this is the worst thing ever” to “well i suppose it’s not that bad” in 9 months time.

  3. Writing was on the wall after Biden telling Boris “fuck around and find out”, Congress + Senate agreeing and the European Commission stating that the Trade and Cooperation Agreement was tied to the Protocol.

If you live in Austria and you feel you are not on equal footing with some business/rule in Northern Ireland, you can sue and UK courts must enforce EU laws through the interpretation of the ECJ.
Similarly for someone living in NI you can sue through Austrian courts and see remedy in a similar fashion.

There was absolutely no way that a “one law, two interpretations” framework could remotely function (even EFTA members defer to the maxims of the ECJ).

Of course UKG will try to minimise, but with time running out + elections in NI in 5 months this is done and dusted. Good job on EU negotiators in keeping their composures not to escalate this.
