    He didn’t have to come to court. The senior garda for the case had discretion to prosecute or not.
    But the judge knows this!

  2. An individual Guards discretion has been completely taken away from them.

    If a Guard finds drugs they have to seize them. If they don’t they face being disciplined. The Guard then has to enter them into the pulse system so they can be disposed of correctly. If they don’t they face being disciplined. Then once they are on the pulse system a corresponding summons or charge has to be created (unless it’s a persons first offense). If the Guard doesn’t prosecute . . . you’ve guessed it . . . they will be disciplined.

    On all these type of posts I see people slating the guard involved. Instead of giving out about Guards and Judges who are sworn to enforce the laws of the land, turn your anger towards the TD’s and people who have the power to change Irelands antiquated drug laws and choose to do nothing !

  3. Opiates are necessary sometimes. But if people can find safer alternatives (which cannabis is), it is absolutely in their best interest. Our regulations are nonsense currently.

    From the article it sounds like he was growing it for himself. There was no charge of supply or intent to, mentioned.

  5. Let the guards know your feelings on the matter at every opportunity. They are ***our*** policing service, we pay through the nose for it, and they should be made acutely aware of public opinion on this issue. Likewise the judiciary and local TD’s.

    However the judiciary is independent of politicians, so people claiming it’s all politicians’ fault and this is the only appropriate avenue to express grievances are incorrect.

    The justice system needs to hear directly from the people, that we are sick to the back teeth of this halfwitted policy, the enormous waste of time and resources it results in, and the boost it gives to organised crime.

    The ‘war on drugs’ needs to go in the same bin as pedo priests.
