Hang on, so yesterday we had a situation where someone was given a fully suspended sentence for helping to effectively torture someone in their own home, and here we have a situation where a person is jailed for three months for telling a guard to fuck off?

Need more stringent guidelines. Judges seem to just make it up as they go. “You told a guard to fuck off? That’ll be three months in the joy good young drunk lad with no convictions.”

I suppose no two court cases and individuals are exactly alike. That is the argument that would be given against prescribing stricter sentencing guidelines.
However according to Kahneman, when they brought in stricter sentencing guidelines for judgesin the United States, there was a reduction in the ‘discrepancies’ in sentencing between different judges when faced with similar scenarios.
So I definitely think stricter sentencing guidelines for judges is the way to go

Totally on the defendant’s side here tbh. The whole business of the Gardai enforcing de facto curfews in urban areas where no actual crime has been committed and no curfew is mandated by law is infuriating and needs to be stamped out.
Genuine question, is it illegal to tell a gaurd to ‘fuck off’. I realise it might not help your case if you’re in trouble but surely that act in and of itself is not illegal.

This case was a waste of tax payer money and court time, it should never have been brought in the first place. Leave the young lad on to live his life. Firstly because it’s a district court conviction he will have appealed it the same day, been released on bail and will have a second chance before a circuit court judge. Secondly, there is literally case law precedent that states telling a guard to fuck off is not an offence under s6 of the public order act
You see its his own fault he didn’t come from a good family or play GAA.
The case probably only lasted 10 minutes and it ruined his life for the next few years.
