Or they could increase numbers and give them adequate resources.
Assault is assault and whether you wear a garda uniform or not shouldn’t impact the punishment someone gets.
Why a maximum sentence rather than a minimum?
Why not just enforce convictions properly?
Without even hazarding a look at the statute book, if memory serves assaulting a peace officer or otherwise interfering with a peace officer in the execution of their duties already has a sentence of a few years at the max?
going from 12 months suspended to 24 months suspended.
Cops, paramedics, firefighters or any emergency service.
And not just on Gardai. For assaults in general.
What do you mean proposal. I don’t care what people think of them. Attacking a member of the Gardai should just be a minimum sentence of 30 days handcuffed to Enoch Burke.
Maximum sentence of 12 years but in reality they’ll be out of the station before their dinner gets cold
I go assaulted by 2 guys, broken nose, tooth, eyesocket, upper jaw, lost 3200 in wages + medical expenses, probably about 5k outta pocket,
One was just off suspended sentence for 2 previous assaults,
They have to may me 4k compensation between them and suspended sentence again, fucking joke I’m still out a grand through no fault of my own. Systems a joke they should do a year in jail each minimum
I don’t see how this helps?
Without a mandatory minimum sentence for violent crimes nothing will change.
Raising the maximum sentence means absolutely nothing ! Maximum sentencing is NEVER applied in Ireland.
Minimum custodial sentences however might make some people think twice and if it doesn’t at least it’ll get them off the streets for awhile if they do assault emergency service personnel.
Another half measure from the government. Their specialty.
Small amount of drugs you’re locked up yet smash a person up you walk. That’s the glaring issue here.
Wasn’t this the case beforehand? But then it created an impression that assaults on non garda civilians was a lesser crime when in reality it should be equal.
Build more prisons.
There’s already a 7 year sentence for assaulting members of an Garda Síochána, Prison officer, Members of the fire brigade, Ambulance personnel or Members of the Defence Forces.
I don’t think I’ve ever heard of somebody getting 7 years for doing that.
If punching a policeman is a sin we might as well pack up and go home
Assault on regular people is fine. No problem there. Do what you wish.
Headline stuff nothing more
And where are they going to put them? The prison’s are already over capacity.
And what about assaulting normal people?
Ireland’s justice system is a joke even the dog on the street knows that.
From suspended sentence to very suspended sentence and a stern warning
No maximum sentences or minimum sentencing term. One fixed and non negotiable sentence for each crime. If you are convicted of crime A you do X time, no debate, no parole, no suspension of sentence, no matter who you are. The grey are opens the system up to abuse, nepotism, the power of daddy’s money, and potential nullification from the inside by those who don’t believe in the system(Nolan for a start). You can sub divided crimes by grade, like the US does with murder, in order to create a slightly more nuanced system, while keeping it fundamentally black and white. I would also be in favour of 3 strikes = life for serious violent crimes. At some point people are irredeemable
This isn’t confined to physical assaults and I doubt the powers they want will be either.
Why not all assault someone using boiling water as a weapon shouldn’t walk free
Would definitely support some sort of case by case basis for this law change, perhaps allowing a jury or judge to take into account the context of how the assault offence occurred when sentencing?
And women, the sentence appears to be incomplete
maybe include assaults on the rest of us while you’re at it
So sentences for Garda who commit crimes should also be increased. If assault against Garda is more serious than against a non Garda, than Garda breaking the law should be considered more serious than non Garda doing.
I think this is so important, if people don’t respect our public workers they should at least fear consequences of attacking them.
Different US states went through the mandatory minimum phase. California instituted the famous “three strikes.”
Isn’t the problem that the judges should be removed from the penalty process ? The fair way would be different. The jury of peers should set the sentence. The magistrate should be an arbiter of the law.
