To get married in Poland, you and your future spouse:

1.must be in good standing (18 years old; a minor over 16 can marry unless she has permission from the family court) ;
2.cannot be formally married;
3.cannot be married to Your fiancé is related by blood (not a brother or sister, not directly related or directly related, or adopted);
4.cannot be mentally ill or disabled (although this requirement is considered partially outdated and has been upheld by Polish courts, but if a situation threatens the marriage or the health of the couple’s children, it can be used to cancel the marriage). Chapter

  1. And you also need either a certificate of no impediment or a ruling by a Polish regional court exempting you from that requirement.

  2. Adding to point 4) If you know that you have mental ilness you have to disclose it before marriage. Like depression – your future spouse should know about it before marriage. Otherwise it could be used to marriage annulment. This is not case if mental problems first appear after marriage.

    Only heavy cases, where mental illness is causing violent, dangerous behavior or is heavily limiting or influencing decision making/intellectual capacity could be obstacle to even get married – especially if someone is refusing treatment.

  3. Religious marriage is not recognized by Polish law as valid marriage. You can have Civil marriage+Religious marriage done together. You are preparing all paperwork for civil marriage and whatever paperwork/procedures/ceremonies are needed by your religion/church. During religious ceremony for marriage you are signing extra papers for civil marriage and after ceremony in church/temple they are send back to registry office. In this scenario priest is kind of “temporary civil clerk” who can proceed paperwork for civil marriage.

    Sure, you can also have pure Religious marriage. But for example in Catholic Church you have to get special permission from bishop to have one. Normally Catholic Church is expecting you to have civil marriage before Religious marriage. Like my cousin was interested in such pure Religious marriage because her fiance company bankrupted. They wanted to be married in eyes of God but not in eyes of tax office or debt collectors.
