
The city in Ammersbek in Schleswig-Holstein had the parking spaces built a month ago but they accepted the design of our house a year ago knowing there would be an entrance and carport there. We have their acceptance in writing with their approval from the architect.
The house construction will begin in April, but now we have to speak to the Gemeinde to ask why they built it this way. We would be the only house on the street with a blocked entrance from some public parking spot and the only house on the street without a proper entrance for our car.
We do plan on speaking with the Gemeinde in person with the Baugutachter and Architect. If they fail to change their mind as blocking that entrance with a random parking is not accessible to my child who is on a stroller and family who are in wheelchairs, then we will speak with a lawyer.
The city said that they had plans before selling the plot of land that whoever bought the home would have an underground parking garage which is something we don’t want to do. So now if they deny our appeal, we would have a useless carport and they won’t let us make the house bigger where the carport would be making a part of our baufenster useless. It makes no sense.
This street is a not-through street with only 10 houses or so around it.

I can’t help you myself but I will say that your approach is perfect: Talk to them, then if that doesn’t work talk to a lawyer – I doubt you’ll find much useful information online without someone having access to all the official documentation, contracts, etc

This sounds like two bureaucrats not communicating with each other. Play your cards right, you could be on *Extra 3*, the satirical TV show that has segments dedicated to bureaucrats making bone-headedly stupid decisions and wasting taxpayers’ money.
Since it is illegal to park a car in a way that blocks a vehicular access, the city is creating a situation where a parking space is illegal to use for parking. Classic *Extra 3* territory.
I think your plan is sensible: talk to the council, and if that doesn’t work talk to a lawyer.
I’m 80% certain the parking space people just didn’t get the update.
Your approach is correct but you probably won’t need a lawyer. If you do get one, get a local one.
I have no advice to give because I’m clueless, but I thought I’d leave r/LegalAdviceGermany here and wish you good luck.
Also, if you ever have an update, would you mind letting me know how this was resolved? I am unfortunately what you’d call a nosy bitch, and I’m weirdly invested in this for some reason.
