Does anyone know where I can find more information about working from home more than the allowable 19 days a year in Germany?

[From what I understand “If you worked at home for more than these maximums, your income would be divided according to how many days you worked at home and how many in Luxembourg, and taxed accordingly by your country of work and country of residence.”](https://www.luxtimes.lu/en/money-and-work/moving-across-the-border-602d7208de135b9236c00d2b)

Does that mean I would have to file my own tax returns?

Has anyone tried it, if so can you please let me know the process as I am considering working from home 52 days per year (once a week) give or take? So would that mean I have to pay tax based on 33 days on my whole income ??

  1. Yes, you become tax liable in both countries. Once you exceed the threshold, you pay tax in Germany for all days worked there, so 52. The good thing is that for those 52 days, you aren’t taxed in Luxembourg, so depending on the exact circumstances it may lead to lower taxation overall.

But a diligent employer won’t let you exceed the 19 days because it exposes them to corporate tax liability in Germany. And if they are naive enough not to care, you should maybe not care more than them.
