Hello people,

How can I resolve this?
It’s about Basic-Fit subscription. I didn’t go there since January.
My subscription was with cancel “anytime future”. I thought you are no frequent the gym, the subscription is cancel automatically.

Please advise,

  1. I would recommend checking out [huissiers.lu](https://huissiers.lu) (the people who sent the letter). Never seen a more questionable looking website. Certainly wouldn’t convince me to use their services.

    Now to answer your question.. I don’t know. Personally I would cancel your BF membership immediately (think you can do this via the app), then pay up for the bill as in reality you have subscribed to a service and then failed to pay. I’ve had similar situations with other companies in the past, and had them refund automatic payments on the grounds that they could clearly see I hadn’t used their service. Given that this has gone to a collector, however, I doubt they would do that in your case.

    That’s me though. The other option would be to call UCL and see if they might offer guidance. Even if you’re not a member they tend to be helpful on the phone – but I would highly recommend joining. It’s a fantastic service and we should all support them if we can! 🙂

  3. The dubious nature of the company / website aside. Do you have a contract saying you’ll pay x amount each month? Have you failed to pay the amount each month? Have you formally cancelled the contract? A contract that includes a clause stating non payment equates to cancellation would be rather unique. If you have simply ceased paying without formally cancelling the contract you are still liable to pay as per the contract.

    The company Pierre Biel & Geofrrey Gallé is legit, I worked with them not long ago.

    Concerning your basic-fit subscription, it doesn’t cancel automatically. I’ve never heard of a gym contract being cancelled automatically if you don’t go to the gym anymore.

    Worth mentioning is, that you most likely already got payment reminders from the gym. The “huissier” is only involved after you have already received several payment reminders.

  5. Cancel your membership.

    Pay your debts. They can and will contact your boss/HR and have the amount deduct automatically from your salary. If that fails, they can enter your home with the police and auction off your belongings.

    And next time read the fine print.

    Also fuck Basic Fit and their subscription model.

  7. Getting this money from people not going to the gym is **at the heart of every gym business model**. They actually hope you will do that at the moment when you sign the contract. You don’t use the machines / water etc etc and still you get charged. You are a perfect model client for them.

  8. Pay only the Basicfit subscription and not the Huissier. They cannot do anything to you to get their ridiculous additional fees (don’t quote me on that I’m not a lawyer)

  9. I am with BF, in the past I left them and cancelled having not been there for a while and had no issues. There was a period I had to wait before it was cancelled but it was fine.

    I would contact the Union of Luxembourg Consumers, it may be too late to join them for this case, but you can try. There fee is quite low and they pay some legal feese etc if required.

  10. Noone seems to understand how basic fit subscription works. You basically subscribe for an entire year, which you pay off monthly. If you cancel your subscription early, you still have to pay for the time left. I know it‘s bullshit, but that‘s their bullshit business model.

  11. That letter is legit. Their website might look dodgy af but so do most websites here in Luxembourg. I believe BF have a membership tier that allows you to cancel whenever, for a premium. So yeah sit in front of that letter and pay the debt. You probably can get away without paying any extra handling fees.
