A few days ago i posted about the legality of using a “european” exhaust in Switzerland. I didn’t get the chance to call the auto service however i found this law article that says it’s allowed. Am I misinterpreting it or is it allowed? For those who don’t speak french It’s[article 53 alinea 3 of the](https://fedlex.data.admin.ch/eli/cc/1995/4425_4425_4425)OTEV

  1. If it’s not an OEM exhaust, you’ll likely need papers from the exhaust manufacturer stating that the product complies with the relevant directives as well as the “Swiss sheet” that confirms the manufacturer’s statement. The latter can be obtained from a Swiss importer, the manufacturer will direct you to the correct address. Be prepared to pay a pretty penny for that sheet.

  2. The article is just about noise, which is only one of the many aspects that are regulated.

You already had many answers in your previous post, if they are not sufficient for you simply call your local department. They have the final say on this topic and are definitely the ones to be asked.

  3. Note: you can get a direct link to each article of the law, when you press one the article title. Here the link to [Art. 53 VTS](https://www.fedlex.admin.ch/eli/cc/1995/4425_4425_4425/de#art_53).

Yes, theoretically it is possible. The problems arise once you try it. In particular the onus to proof that a certain exhaust conforms to the listed regulations and is approved for your motorcycle is upon you. Dette portable / Bringschuld.

As stated [in the other threa](https://www.reddit.com/r/Switzerland/comments/12rhok4/motorcycle_exhaust_laws/)t, it is up to discussion and interpretation of the SAN/StVA which proofs and papers constitutes as such a proof. You find it deep with in the [règlement (UE) no 168/2013](https://eur-lex.europa.eu/legal-content/EN/ALL/?uri=celex:32013R0168) and [règlement délégué (UE) no 134/2014](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=celex%3A32014R0134). In the minimum, you must be able to produce a booklet or leaflets providing the following information:

    * The trade name or mark of the manufacturer of the replacement silencing system and its components,
    * The address of the manufacturer or his representative,
    * A list of vehicle models for which the replacement silencing system is intended.
    * Instructions explaining in detail the correct method of mounting on the vehicle,
    * Instructions for handling the silencing system,
    * A list of components with the numbers of the corresponding parts, excluding retainers

More or less, SAN/StVA must be able to check that the exhaust you have mounted is intended for your vehicle, all parts have been mounted correctly. If you do not get all this information from the seller you must must request them. Unfortunately. some manufacture papers are clearly insufficient, as they do not name the vehicle for which the exhaust is approved in a proper way. Some manufacturers are cooperative and will provide you the proper papers, some others simply do not care as it is a non issue every where else. Further, and more anoyingly, you still have to convince the SAN/StVA that all your papers are according the relevant EU regulations.

Interestingly, a statement from a Swiss importer does not have to contain the latter three information.
