Man avoids jail for breaking police officer’s nose and eye socket

    Without repercussions these people will continue with this kind of behaviour. Why would they stop, there’s absolutely zero punishment or deterrents.

    If you protest peaceful you get 5 years

    If you attack someone you don’t even go to prison

  6. So, I was very confused by this because the Sentencing Council provides that this offence is actually anything from community order – 7 years custodial.

    “Looking at the scoring on this, I think it’s reasonable to say that it’s Category A culpability – because “Victim obviously vulnerable due to age, personal characteristics or circumstances” (he was impaired by restraining someone else) and “Prolonged/persistent assault” – the offender reportedly punched him twice more after he was knocked unconcious.

    If we’re going to be charitable, maybe some of that wasn’t provable, and this was a Category B culpability.

    So Culpability A or B.

    Harm category is harder to do, and always is for GBH, because the wording is _dogshit_, but I think it’s fair to say this resulted in a “Grave injury” – making it Category 2.

    Assuming the _best_ possible outcome, for the defendant, this is cat B1, starting point is 2 years custodial, and range is 1-3 years.

    The assault being on an emergency worker is an aggravating factor, age/lack of maturity is a mitigating factor, so it seems this guy should’ve got the 2 years, but suspension was allowed if the sentencer didn’t consider that they were a danger to the community, and were likely to rehabilitate – I’m not sure I agree that this shouldn’t have been a custodial sentence.

    Then I saw this:

    And it all made sense.

  7. What a disgrace, some judges need to be recalled or sacked or whatever the terminology is, this is absolutely outrageous sentencing. The UK justice system is a complete joke

  8. Assault and physical violence isn’t taken anywhere near seriously in this country imo. You punch someone and they fall they could die. Jail should be the minimum expectation with community service and some sort of anger management expected as add ons.

    There’s got to be some reason why us brits are fast to fists

  9. Tale of 2 ridiculous extremes.

    In the US, that kid would have so many bullet holes in his face he wouldn’t even be identifiable.

    Here, nothing happens to that kid, despite committing a violent assault, as a adult.

    What is wrong with these places?

  10. An appalling state of affairs.

    A horrifying precedent that will only embolden the cowardly thugs of the future with the types of personalities that will gladly do the crime never regretting harming the victim but will resort to almost anything to avoid the inconvenience of doing the time in jail or a secure unit.

    Every resident uk citizen who unlawfully attacks a police officer where the attack results in multiple bruises or something even worse should be guaranteed an incarceration sentence. Plus made liable for both the total costs of prosecuting them and crippling compensation payable to the victim or their next of kin. Along with thousands of hours of community service to occupy almost all their leisure time for the next 15-25 years.
