Driving home this afternoon, hit some construction material left on the A1 near the Senningerberg exit. Didn’t see it on time as the car in front drove over it and sent it under my car. I ended up driving over it, same as the car behind me, and probably a few hundred cars after that. Got home to find fluid leaking from the front and the plastic cover under the car broken. Probably the coolant leaking out. Left the car in the local garage and they’ll let me know next week how bad it is.
I’m told by my insurance that this is not covered as I do not have full comp (kasko). Is there any legal recourse? Later it was on [wort.lu](https://wort.lu) and [cita.lu](https://cita.lu) that “objects” were being removed from A1 and N1.
My best guess is that some idiot truck with unsecured load dropped some of it on the A1, then took the exit and dropped some more on the N1.

Unless they can identify the owner of the pieces, it will be your cash to pay for the dammage.
Sorry.
Bad luck. It might cost you less than the cost of the extra insurance during a year.
if you were in the USA you could sue the ponts et chaussees.
Fluid leakage after debris can be anything from a damaged pipe to damaged brake system or cooler… So wait what your garage says before trying any action as it might simply not be worth the time, effort and cost.
That said, you can have the police take your complaint against an unknown party (plainte contre inconnu). It’s not likely to help but if the owner is identified (not probable) you have a case against him.
I almost got killed on the highway by a large plank falling off of the pickup van in front of me. I tried to evade at 130 km/h and crashed my car into a wall. Luckily I didn’t get hurt seriously, but my car was totalled. The driver of the truck got fined 75€ for not securing their cargo.
We had the same happen to us this week. Coolant started to leak out. We had to get the car towed.
