Britain’s libel laws are in desperate need of reform.
Not a lawyer and presumably she’s looked into this, but are libel debts cleared during a bankruptcy?
I think the comments here are missing the point. She made an accusation that couldn’t be proven and that was always going to leave her vulnerable to a libel case. It’s a textbook libel case, a damaging accusation made to a large audience without proof.
It doesn’t matter if you don’t like Banks and it doesn’t matter if you think it’s true when you can’t prove it. Courts don’t work on vibes.
Cadwalladr herself dropped the truth defence quite early on in these proceedings and even in this recent appeal she seemed to have also depended on TED Talks being the publisher and not her:

This isn’t a case of it being ridiculous a court decided it wasn’t true. Even the initial court case she successfully defended didn’t find it was true. Her legal defence wasn’t that it was true. What’s happened here is the initial verdict didn’t find it reached the level of being that damaging and there was a public interest defence in her saying it. Bank’s appealed that and won. There was also disagreement in the verdicts about if it was damaging enough to warrant a libel case.
This isn’t a case where the fundamental accusation can be proven but the accused decides to just tie up the accuser in legal cases to deplete their funds/make it difficult but knows they won’t win. Banks sued on the basis of the accusation itself and won.
You can change the libel laws but a case like this is still going to happen unless you remove libel altogether.
On a wider point, I remember John Oliver doing a segment on his show on the validity of SLAPPs in the states.

Interestingly the senior judge responsible for the decision to make Carole pay such a huge amount (for an individual) is the sister of disgraced former BBC Chairman and Tory Richard Sharp. I’m not saying the two are linked by the way, but it’s certainly a good example of the establishment running the country.
A couple of folk in the comments pretending Banks had nothing to do with Russia. He’s had to pay half of his court costs, it’s a complex case. In addition, fellow journalist Isabelle Oakeshott stated,
“I am in no doubt that Banks and Wigmore have been acting as agents of influence for the Russian state”.
For some reason this girlfriend of prominent Brexiter Richard Tice wasn’t also sued by Banks.
I remember when this sub had a huge fetish for upvoting all of Cadswallop’s lies. Still some shills defending her even where she is not defending herself.
Don’t make up things and you won’t get done for libel.

Carole said something specific, Banks then claimed she said something slightly different – which he would’ve lost, but then the judge interprets it his way thereby turning the tide and Carole losing.
