  1. Seems like this is more the letting agency (who are always vultures tbh) than the landlord insisting on this.

  2. Whilst obviously this is entirely devoid of compassion, that is kinda the point of a guarantor? Sure, not being “trustworthy” enough to pay your bills is usually the primary reason but the general idea being “we want a guarantee we get our money regardless of circumstances”.

    Fully support some form of protection being put into law for specific scenarios like this one though.

  3. So I presume the flat will remain empty as it is contracted to the deceased student who’s guarantors are paying the rent? And the letting agency wont be getting double rent by housing someone else there?

    So of their own free will they signed a contract that specifically covered this scenario? Tragic certainly, but this is why contracts exist.

    If they objected to this clause maybe they shouldn’t have signed the agreement?

    I’d prefer such clauses be made illegal (along with many other things in some badly needed tenancy reform) but ultimately, don’t legally consent to things if you don’t agree with them.

  7. Lot of people wagging their fingers and preparing their “well, actually…” over the contract details but missing the key point that charging grieving parents rent for their dead son’s apartment is just a horrible thing to do.

  8. While it is, as they say, abhorrent, this is nothing new. This is the responsibility of a guarantor. A lease was signed, and all parties should hold themselves to that agreement. It is not the leasing agency’s fault that the holder of the tenancy agreement has committed suicide, so why should they lose money. I find it also not really acceptable, that while it is a shit situation for these parents, making it public, and playing on the sympathy vote to get out of their contractual obligations should really be frowned upon. It has always been stressed to read the small print.
