In Italian law (and probably everywhere else) you have to prove that some damage has been done willingly, unless otherwise specified in the law (ie: involuntary manslaughter). It’s not about 1 or 10 seconds, it’s about proving someone did something with the clear intention of causing damage. Probably the prosecutor failed to prove that then the judge had to drop charges.
Would be cool if a lawyer could explain what likely happened there.
