  1. Yes it’s so easy to forget the passcode to a device you used dozens of times a day for years

  2. Section 49 of the Regulation of Investigatory Powers Act 2000

A RIPA notice could be served if the police believe that:

You have the password or PIN Code
The notice is essential, such as if it protects national security

    The notice is proportionate

The required data cannot be obtained using other methods

Failing to comply with a RIPA notice can lead to a maximum sentence of 2 years in prison.

  3. There must be some really shady stuff said that he is delaying this so long.

At this stage I am surprised he hasn’t done a remote wipe and just said “Oops I pressed the wrong button.”

  4. I don’t know why he just doesn’t use the excuse that he tried to migrate the old conversations to a new phone and they got wiped.

I’ve legitimately had this happen – didn’t transfer to the new phone, wiped from the old phone. Just fucking *gone* nothing Whatsapp could do, they don’t even have customer service.

This is a watertight excuse rather than this flimsy obvious lie.

  5. Same thing happened to me when I was arrested on the charge of running a large multi-national drugs ring. Told them I’d forgotten the password to my phone with all the evidence on it, so they dropped all charges.

Nothing they can do. Simple as.

  6. Ah well that’s alright, Boris has just made himself unelectable until he does *suddenly* remember the passcode.

  7. Well I believe him, let’s just forget about the whole thing, we tried our best etc.

Stick him in jail like that guy in Southampton who claimed he couldn’t remember his Facebook login. That’s going to jog his memory…

  8. Of course he can’t. Maybe it’s in his black book with all the other numbers.

  9. I believe that is illegal and you get a 2 year sentence for failing to decrypt it.

  10. well thank goodness he facilitated lots of government direction towards banning encryption then! should be a doddle

  11. PM can’t remember his own daily used pass codes, great.. now I fear Trident launch codes may well have just been 1234 for his entire time as PM.

  12. Has the phone been secured? He’s not able to take it on quick ferry trip to do a Vardy?

  13. To be fair the password might be the answer to the question ‘how many kids have you got?’, in which case there’s no way he’s remembering it.

  14. They put pressure on to try block end to end encryption on messengers like WhatsApp, and now he hides behind it.. the irony
