Hello everyone,

I am employed in Germany and currently living on a work permit (started Jan 2023),

I had 300 Euros in [Freelancer.com](https://Freelancer.com) from an old job I did 2 years ago, and a month ago I withdraw the 300 Euros to my German bank account,

Should I pay taxes or do tax declaration on this money, it is from an old job so I didn’t do any side work while in Germany

  1. You should have paid taxes on that 2 years ago

    – edit – were you living in germany at the time, and how is your setup with the finanzamt for self employment?

  2. Where was your residence in that year when you did the job?

  3. This is an unpleasant situation, technically yes, because you always pay taxes on income you receive in a certain year, but you obviously have no legal form to create that income (no tax number for freelancing and no corporate form) and without a fitting visa you are technically not allowed to earn that money. That is definitely a thing I wouldn’t do without a lawyer or tax consultant, who will also be more expensive than 300 Euro. You probably could just file a tax form and declare it as ‘sonstige Einkünfte’ which is technically for earnings from privately lending stuff to people and some other special legal cases, but it would tax the amount without opening a can of worms, but you would technically lie on a tax form. This is only a crime if you do it to withhold taxes, but if the tax office asks questions, you will have to do a lot of explaining and it will take a lot of official paperwork to resolve it.
