Hi everyone, I have a friend from India who is studying masters in Germany, living here since June 2023. When he was in India, he found a shared room with an Indian couple for a warm rent of 400 euros outside of Erlangen city ( 7km) . Agreement is that he will be sharing the bedroom with two people and kitchen, bathroom with tenants from other rooms ( 3 more people ) .

He signed the contract while he was in India, and the landlord informed him the following.

1. he will be sharing the apartment only with 5 people but after coming here he found out he is sharing 10 more people( all Indian students ) living with one small kitchen, two toilets and bathroom. Now he denies he ever said that

2. Even thought it’s time bound contract for 1year , they informed him he can move out after 6 months ( it’s an oral agreement). Even this he denies

After he moved in, he found out there are in total 11 people living as opposed to 6 people. He wanted to move out as the kitchen was super small and it’s crowded apartment.

But the landlord wants him to pay till next year mid as mentioned in the contract. Or find a sub tenant after 3 months to continue the remaining period

Unfortunately, no one will be willing to pay 400 euros to share bedroom with two people and apartment with 10 people.

Another way is to find some student in India using their desperation to find apartment in Germany, which he is not willing to do as the room is super bad

Also his roommates continuously smoke tobacco and other products, when he complained for weeks to the landlord, he ignored him and didn’t take any action.

Due to his lack of knowledge, he signed a contract believing the verbal agreement since both are of same nationalities. As much as he is at fault, he is finding hard to live there as even cooking is not possible due to all 10 Indian students sharing kitchen and cooking.

The contract itself feels not good as lawyer friend of mine told the termination clause is not in right format.

Could any one of you kindly look at the contract and tell if there is anything we can use to go to court or tenant protection association to come out of it.

Is lying about number of people, a valid reason to come out of it ? Even though he doesn’t have proof except his three roommates who also have been told that there were only 6 people living. But again it’s all verbal.
