It all really comes down to whether this was known at the time of the agreement. Network Rail are making out that it was, RMT doesn’t seem to be denying it.
I don’t think it amounts to penalising union activity as it’s not taking something away. Makes no difference in practice of course, but suspect the RMT need a better argument.
