No. Only when it can be credibly confused with it. Pingu is obviously just waving, he isn’t standing straight with straight arm.
And then it also only becomes illegal when you do it in public, or distribute content with it. Artist freedom also gets around it, an actor can depict it, artworks can make parodies of it, history books may show it to kids in school
