
According to the BMI website (https://www.bmi.bund.de/SharedDocs/faqs/DE/themen/verfassung/brexit/faqs-brexit.html), I automatically have the right to permanent residency after 5 years of residency (which I now have). I applied for permanent residency at my local Ausländerbehörde 4 months ago and I still did not get a reply yet. I am currently travelling and have been out of the country (and unemployed) for 3 months now.
Am I allowed to be outside of the country for more than 6 months now, or do I have to wait for the permanent residence card from the Ausländerbehörde first?
P.S. I have already spoken with a Lawyer and he agrees that I have the right to permanent residency now but has advised me to not leave the country for more than 6 months until I have clarified with the Ausländerbehörde when exactly I will receive the permanent residency. I’m just wondering if anyone else in this sub has had a similar experience and can give me any advice, thank you!

The issuing of the card does not change your rights in this regard. You can leave for up to 5 years. The card gives you an easily verifiable method of identity to prove to border controls that you have the title. Put simply- you automatically assume the title and the card is issued to make things run more smoothly. Your lawyer appears to be mixing up the rules for normal PR with the WA PR. One allows 6 months (up to 12 if a family member dies ect) the other allows you 5 years outside the country. Don’t be surprised at all if the ALB doesn’t care for any of this and instead tries to hang you out to dry, though.
