By their own rules, imprisoning a woman who is pregnant should be illegal because the fetus, as a person under the law, has been denied due process and been jailed for a crime they did not commit.

Good grief. Pregnant women who test positive for meth need drug rehabilitation treatment, not prison. If you want to charge then with something, the sentence should be rehab, time served.
