The appearance of masked men in the public gallery of Belfast’s Crown Court was not acceptable, Northern Ireland’s head of judiciary has said.
It comes after a number of men attending the trial of Belfast man James Smyth (51), who is accused of killing 41-year-old Eamon Fox, a father-of-six, and Gary Convie (24), a father-of-one, in March 1994 as they sat in their car eating lunch.
A third man in the back seat escaped the attack.
UVF ‘supergrass’ Gary Haggarty — seen in public for the first time since 2009 — gave evidence at the trial.
The masked men remained unchallenged for the court’s morning session despite a heavy police presence both inside and outside the court, before the judge warned before the afternoon session that anyone covering their face would be removed.
Most of the men then left of their own accord.
A spokesperson for Lady Chief Justice of Northern Ireland, Dame Siobhan Keegan, said the appearance of masked men in the gallery of a courtroom was “not acceptable”.
“The Lady Chief Justice considers that this was not acceptable and should not have happened,” they said.
“The Judge dealt with the matter appropriately when it was brought to his attention.
“The Lady Chief Justice has asked NICTS to identify how this incident occurred.”
The masked men sat just a few feet from the Fox and Convie families, who have attended each day of the the trial since it began last week.
Solicitor for the families, Pádraig Ó Muirigh, said he had informed police with his concerns about the development.
“The presence of individuals with face coverings and baseball caps in the public gallery created an intimidating atmosphere for the families of the deceased,” he said.
“This is unacceptable in a court of law and I made police aware of these concerns.”
The PSNI have been approached for a response.
