  3. It’s an interesting legal theory. I think there is a good case to be made that the 14th Amendment bars trump from running for office. But, in practice, I don’t think it’s going to happen.

    Unfortunately, there isn’t going to be an easy way out of this. The only way we can ensure that trump doesn’t regain power is to vote for Joe Biden in 2024

  5. I really hope this doesn’t happen. Since it doesn’t require a conviction, I can totally see the GOP using this same tactic against eating Dem candidates, and the presidential race will sink even further into a morass of individual state lawsuits.

    I am no MAGA fan, but this seems like a strategy that can work equally bad in both directions

  6. This is a dangerous court case that has a tremendous amount of potential to give Trump even more ammunition.

  7. Could actually backfire… if blocked from running, definitely a lot for MAGA to shout and get pumped up about. And could even get overturned with Supreme Court.

    If not blocked and allowed to go forward, this will get spun as validation that Trump didn’t contribute to an insurrection.

    It is definitely gray area. Without another actual conviction, “insurrectionist” is not very clear.

  8. Good. I support the 14th amendment. No one who engaged in insurrection is eligible to hold government office. This is an entirely reasonable provision to any government, and is a self-executing condition.

    Really hope this bastard is disqualified. He’s earned it.

  11. We’re absolutely not about to find out. There will be court cases, motions, delays, appeals, more appeals, and a Supreme Court case.

  13. He shouldn’t be banned from ballots until/unless he’s convicted. Doing so violates due process but more importantly this will just become a new weapon in the GOP arsenal for any and every Democrat they think might win

    Judges for the remaining cases now have an easy out from ruling on this at all.

  19. Doesn’t he have to CHARGED with insurrection in some jurisdiction first? That hasn’t happened anywhere – state or federal. He’s been charged with lots of things in lots of places, just not insurrection per se.

    Don’t get me wrong, not a fan of Trump, I just like seeing things done in an orderly way. This effort just seems like something being thrown out there, hoping it’ll stick.

  20. This is a bad idea and will back fire, Am no fan of Trump or Biden as I think we can do better but you can’t just keep him off no matter how bad you think he is unless there is a conviction, innocent till proven etc etc.

    Trump should be Unable to run next year on logistics. He’s going to be bouncing around court-rooms for a significant part of next year he’s genuinely not got time to be running

But Congress may by a vote of two-thirds of each House, remove such disability.

    It sounds to me like he is ineligible to serve as US President due to engaging in an insurrection or rebellion against the United States.

    If I was a US Supreme Court Judge, I would disqualify him. And it wouldn’t even be a close or difficult decision.

    Until there’s a conviction there is nothing legally to base his removal on.

  29. I worry this would only happen in deep blue states trump cant win anyway. Then it will be politicized and the deep red states will pull biden from the ballot because of hunters penis or something. Then this will be our new norm.
