Hi all! I’m looking to get an idea of the kind of penalty my wife and I will get after last night’s drive.
Here’s what happened (see photo for visual reference):
We were in a intersection, second lane to go straight and waiting during red light right at the front (circle with an “X”). In the moment, my wife remembered that the street ahead was partially closed due to some sort of construction work. On the right side, there was green arrow light. As it was 3 AM, the street was completely empty, so she decided to go the street on the right and avoid the construction zone. While on front of us we still had red light, she steered to the right and went towards the corner. The green right arrow turns yellow as we turn, and somewhere in between, we got flashed.
Not ideal, not a clever move, we know.
In your experience, what do you think we will receive as a fine? We’re not sure if we got flashed because of the lane change, the lane change during red light, the right turn while on yellow light, or all of them.
Funny side. After three years of living in Germany without a car, we just leased one last week, and just before we started driving yesterday, my wife said “awesome, third day and no fines yet!”. Now maybe we will need to pay a fat fine and she may need to give up her license for sometime, and I haven’t done mine yet. Back to U-Bahns! Lol.
She’s German and she has a license if it helps figuring out the possible outcome.
Thank you all and drive safe!🤙🏻

The [ADAC](https://www.adac.de/verkehr/recht/bussgeld-punkte/rote-ampel-ueberfahren/) has some infos about that.
What exactly you were flashed for depends on what the Blitzer was set up for, to answer that it might need a person with knowledge about the local situation.
I guess this will be seen as a “Rotlichtverstoß”, with the lights being red for more than 1 second. Fine is at least 200€ (plus fees), 2 points, and giving up the license for a month.
Edit: This article might be worth reading: https://www.haufe.de/recht/weitere-rechtsgebiete/verkehrsrecht/bussgeld-bei-spurwechsel-von-roter-zu-gruener-ampel_212_569130.html (in German)
You won’t get flashed for a lane change – I don’t know the location but I think you got flashed by a red light speed camera. You had red light on your lane and switched the lane – most likely you touched the sensors for the camera on your lane while switching lanes causing the flash.
Costs about 200€ + fees and one month driving ban. Maybe you can get out of it by telling the Bußgeldbehörde what you really did. But I’m not a. Lawyer for traffic law
It looks like a Rotlichtverstoß. On your photo it looks like there was an induction loop in front of the stop line for the three lanes that went straight. By turning right you went pass the stop line, which triggered the sensor for the red light flasher.
Now it depends on the position of the flasher and when you were flashed. If you were flashed on the side when you turned and the driver’s face and your licence plate were not visible in the resulted photo, I highly doubt that something will come out of this.
Otherwise it was a “qualifizierter Rotlichtverstoß”: 200€ fine, 1 month driving ban and 2 points in Flensburg. If you are on Probezeit, that was also an A-Verstoß, you will have to take part in an Aufbauseminar and your Probezeit will be extended to 4 years.
