Judge rules Scottish Government rent freeze ‘not unlawful’. Scottish Greens said families who benefited from the cap will be ‘breathing a sigh of relief’.

  1. Excellent! Now close all the loopholes and make it permanent

  2. Good run of wins for ScotGov/the SNP-Greens at the Court of Session. In three days, the Court has upheld the Glasgow ULEZ, the gender representation on public boards scheme, and the rent freeze.

I do, however, wonder whether too much power is given to the courts in our devolution settlement. (and the administrative state more generally). This comment is instructive:

    >This action was raised in a fast-moving situation amid genuine and widely-held concerns that the Scottish Government was not striking the right balance between the interests of tenants and landlords.

Why is it the job of the courts to decide whether ScotGov has struck the right balance between the interests of tenants and landlords? The policy might be a good one. It might be a shit one. (I actually tend to the latter view, given its second-order effects on housing supply.) But that’s beside the point. The court’s role, at least as traditionally understood, is to decide whether the policy is lawful, not whether it is a good idea. But arguments about proportionality etc risk blurring that sharp dividing line, and I prefer the more traditional view that if landlords want rid of this policy, they should convince a political party to take that to the electorate at the next election.

  3. >Scottish Greens said families who benefited from the cap will be ‘breathing a sigh of relief’.

Aye, right until the ‘For Sale’ signs go up.

Patrick Harvey and Lorna Slater haven’t got a fucking clue.

  4. Now watch as the small landlords sell their properties to corporations and the corporations will be worse than the small private landlords at everything while charging for every little thing to bleed the tenants dry.

  5. Rent caps don’t work and never have and you will find no economist supporting them. Yet you all love them and think you are 100% correct in literally everything you do or say. Kinda sad really.

  6. Does it really matter? When this heat pump enforcement comes in regarding selling/ renting properties, there will be no rental accommodation. It’s not worth the cost. So buckle up for a drop in properties being available to rent thanks to SNP/Green Party policies. Oh, and remember how ‘bad’ landlords are when there is an increase in destitute people and families. That relief won’t be lasting long.

  7. >Scottish Greens said families who benefited from the cap will be ‘breathing a sigh of relief

Ok, but what about those that suffered? Those that needed a new lease in the last 3 years?

  8. Who in their right mind would think this as being unlawful. Make note of who was against it 😤 shocking

  9. Anyone who owns more than 1 home (unless 1 is a holiday home) are vultures

  10. I’m a victim of these great new laws. The bad landlords get you evicted under the pretence of selling just to rent it out to someone else for more while you’re struggling to find anything whatsoever and all the rental prices are ridiculously inflated due to demand. Professional Landlords find loopholes while it’s tenants again who suffer the most

  11. It’s also obvious you are oblivious to the cost of certifying your property for rental. So talking about a subject you know nothing about or have any experience of makes you sound even more of a gobshite.
