  9. I get the sense no one wants to be the one to kick him off the ballot. The judge basically said he’s an insurrectionist but maybe it’s unclear whether the 14th amendment applies to the office of the presidency??? If potus was exempt it would have been clearly written somewhere and it’s not.

I laughed in confusion when I saw in a video explaining what happened and when the person said “isn’t it absurd when they read it like ‘any office of the government ***except*** the presidency’???” There’s no way 14A specifically says that. It’s disturbing that people are walking on eggshells involving Trump.

    an American President has never seen the judiciary consider guilt or innocence. every action will be debated for generations. if Trump were to be set free over a technicality, the emotional impact on America would be devastating. if Trump were to be convicted without the upmost due diligence, the rule of law would be devastated.

  21. We already have a legislative process in place for presidents called impeachment. Unfortunately that didn’t work because of politics. But now we are using the judicial process. Unfortunately that isn’t working because of politics. If he gets elected again, maybe impeachment will work the third time. And if not, we can try the judicial process again after he completes four more terms, gets rid of all the judges, and dies in office.

  25. I never expected him to actually get removed from the ballot and if he only lost this election on a technicality, we’re just delaying the fascist takeover of America rather than repelling it.

    HOWEVER what annoys me most is that headlines are all “Trump stays on Colorado
    Ballet” and not **“Colorado judge finds Trump committed insurrection on Jan 6th.”**

    Like, that’s kind of a big deal right?

  26. It would have been better (for us, which, y’know, is spelled U.S., which I just noticed) for the judge to remove Trump from the ballot. So this is not the worst decision. However, the ruling does set precedent that **every** January 6 participant, short of Trump and Pence, is precluded from holding office. So that is good.

    The 14th amendment, in **two ways**, excludes the President from the enforcement of the law.

    First, it explicitly lists all the offices it does cover. “*Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State*”. That’s every federal and state office except POTUS and VPOTUS.

    Second is this clause: “*having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to **support the Constitution** of the United States*”. The presidential oath appears to be the only one that exclude ls the word support.

  30. Trump can’t lose in a courtroom and have this go away. He needs to lose in the elections again, badly. The problem is not really Trump, it is the people voting for him. We don’t really want to say that because some of these people are family and friends. But even if Trump is put in jail, they will build another just like him and he will probably be worse. he may actually be good at his job and intelligent, that is my biggest fear.
