All right everybody, listen up–lying is free speech. Carry on.
Unless you are using those lies for financial gain or power, then it’s fraud.
Not when they put people in danger.
MAGA freaks: “He’s telling the truth!”
Trump: “Lying is free speech!”
MAGA freaks: “Um… yeah!”
Is the playboy family values or judeo christian? What porn would Jesus read?
That isn’t the basis of the case, though. Not one charge was brought on the basis of Trump’s lies. Rather, Trump was charged because he took specific *actions* designed to result in January 6th, knowingly and with intent.
He can lie about it all he wants. Smith is very clear about that in the original indictment. That isn’t what he’s being charged over.
This from the man that has just sued MSNBC, Reuters and 18 other news orgs for misreporting $73 Million Truth Social Losses (remember the losses are apparently only $31m)
You can say whatever you want in life, that’s the joy of free speech.
I can walk down the street declaring i’m the king of the universe and everyone should kiss my feet. If someone believes me, that’s on them…. no law broken
However, if statements are made in the context of FRAUD, then you go jail.
*they said that the federal election interference case against Trump is based on his alleged “lies” and that lies and false statements are protected under the First Amendment of the Constitution.*
Even if we allowed for this nonsense. It isnt about what he said, its about what he did.
Subtle work there Trumpy.
I mean, I suppose it depends on what type of false statements. Liable and slander are not free speech but telling people the world is flat or that the sky is green, while false, is perfectly fine
So, I can say over any social media or news networks that “Donald Trump is dead” (which, at this moment, is a false statement) because I have free speech. But I would still have to face the consequences and so must Trump. He has always used false statements to prop up his cons. But they have always been cons. The man is NOT FIT for any role as a “public servant” let alone the presidency.
Not if it leads to the harm of another person. You cannot knowing lie about a property value.
So wouldn’t this be an admission that he purposely incited violence?
>And so are slander and libel and threats! I do what I want! Respect my authoritah!
– Some rapey insurrectionist.
Funny how free speech for Trump is Fraud for most people….
This is a lazy and tired argument and his lawyers know it. There is a big difference between “i dont like the government” and “hey, somebody should really take a gun to the local DA’s office and cause problems”. The latter is where the crime begins, aka your client.
Here’s a suggestion : lock him up
True, but irrelevant.
Donald Trump’s lawyers want you to think this is about freedom of speech.
I believe we do have the freedom of speech to lie. However, when we sign something and attest to it being true then we can be legally held responsible for any lies.
AFAIK you aren’t allowed to lie to your government. There’s no situation where that would be acceptable. Get caught in a lie there and it’s bad news.
People are really dense when it comes to free speech they really have no idea wtf they are talking about.
I wonder, are they still grasping at plastic straws or did they have to switch to those shitty paper ones.
Isn’t he currently trying to sue multiple news agencies for reporting on how poorly his companies are doing?
False statements that cause harm are not free speech. They’re called libel or slander.
Does it strike anybody else as odd that every single time the right wing defends “freedom”, it’s the freedom to do something evil?
That should be an automatic disbarment.
Perjury is free speech. Lying to the FBI is free speech. Having Judges, witnesses, prosecutors, juries, and their families killed is free speech.
Given that Trump is on tier 9 of the 2 tier justice system, I expect him to get away with any and all of those.
Trump’s lawyers want to have their cake and eat it to.
It’s actually completely reasonable to argue that false statements are free speech, because they are. You can brag all you want about that hole-in-one no one saw you make or the size of the fish you caught last summer. Go right ahead.
The problem that Trump is caught up in is using false statements to commit a fraud on the American people. His lawyers want to argue that it can’t be fraud by misrepresentation because the *misrepresentation* is free speech, wholly ignoring the fraud part.
No one is saying you can’t lie. But the consequences are also attached to those lies
I mean true, but when it’s in a court of law; it matters.
Guilty verdicts are free speech too
Lol ok, that doesn’t make it true? And not all speech is protected btw.
