**Revision, change and adaptation of sexual law in Luxembourg**
**Goal of the petition**
Protection of children, teenagers and adults that fell victim to sexual abuse/violence, appropriate legal consequences for the offenders, in regard to psycho-traumatic and long-lasting physiological health issues of the victims. This should happen through (but not limited to) the following changes: redefining the term ’rape’ – cancel the limitation period for sexual crimes – appropriate sentences for sexual offenders.
**Motivation of this petition:**
Further/re-define the term of ’rape’: in Luxembourg, as in other European countries, the term ’rape’ should go further (?). Abuse of a victim that is paralysed by fear, under shock/trauma, that is sleeping or that can’t act consciously due to alcohol or drugs and that is not aware of their surroundings and thus cannot defend themselves is considered as ‘abuse’ and not ‘rape’. This differentiation, which also coincides with the legal code, should be revised to better protect the victim (preventively) and better support them. Limitation period and sentences: inadequate limitation periods, along with the extent of penalties for sexual crime represent the recovery of the victims’ great, nearly impossible obstacles and partially even the legitimate fear of further trauma. Further more, many victims remain silent, as they consider it too late or as they are convinced, the offender would receive no or little punishment and as they require a great amount of strength and support to complete the process of a lawsuit. Before a victim may find the strength, with the necessary support and therapy, to defend themselves against the offender (especially regarding massive abuse and rape along with mental pressure over years of childhood and youth) the penalty may be in lapse. Further more, victims suffer from dissociation, memory loss, especially when the contact with the offender remains and a lack of internal and external safety for the victims. Also the probation for sexual offenders (also regarding crimes against minors) disturbs victims and it gives them the feeling that ‘there’s no point’ to protect themselves. Thusly the dark number of sexual abuse victims remains high. Estimations go from 1 to 5 people that go through sexual abuse/violence (*They misspelled a word here in the original 😅*). Therefore the legal code and definitions should be revised to show victims that their suffering is taken seriously and that their input is not without value.
