Hello!

In August of 2022 I received an intimidation letter from some law firm saying that I had torrented an anime I have never heard of

Perhaps my wifi was hacked I do not know- but I submitted my objection letter that August and never heard a thing until yesterday when I received a letter saying I am being taken to court

The letters seem to indicate that I have 2 weeks to send a letter defending myself and objecting to these false claims.

I am uploading the letters here, can anyone please confirm where I am supposed to address my letter and any relevant information I should include?

I assume I should include the case number etc but if there are any other formalities I should be sure to include please let me know- I would be very grateful for your advice

  2. You have to address the „Verteidigungsanzeige“ to the court (§ 276 Sec 1 ZPO). Basically just a letter saying that you‘ll defend yourself against the suit. Not really any formalities, except that you need to do it within two weeks. You can file the actual „Klageerwiderung“ separately.

    But I would very strongly suggest that you‘ll talk to a lawyer at this point!

    This is nothing to joke about, there’s unreasonably large fines. Get a lawyer immediately. Court will pay for the lawyer once the case was decided in your favor. If you don’t have the money you can request one for free.

  5. You need to send your statement to the Amtsgericht Charlottenburg within two weeks saying you want to defend yourself.

    But, especially if your German isn’t great, you really should get a lawyer. Only a lawyer who reviews your case can advise you what’s the best course of action going forward. Keep in mind, if you lose the case completely you will have to pay court fees and legal fees. So you really need to be able to understand everything.

  6. wel.. you received a letter from a law firm in august 2022 and didn’t get a lawyer, that was a really bad idea. not a year later they’re going to court because you still haven’t paid and the case still isn’t closed and now they want to see you in court. you’re somehow still not thinking to get a lawyer and ask for advice on reddit?

    you have 2 weeks until this gets discussed in court, you either show up in person and have no lawyer and will most likely lose since you have no clue what kind of evidences they have or you get a lawyer as quick as possible and let him handle the situation.

    so let me repeat what everybody else already told you: get a lawyer! and don’t wait so long next time something like this happens, this can get really expensive for you
