    there is no reason for the conservative cause they believe in to continue to be anchored to Donald Trump. Trump is a damaged, weak, defeated vessel with January 6 baggage and a rape civil judgement tacked on following his 2020 election result that already made him a largely nonviable future presidential candidate.

    The long-term conservative cause is in the conservative Supreme Court majority’s hands. They are the most long-term entrenched, protected, and mentally capable form of the conservative movement, built for this purpose, to oversee the future of the movement and flex its power through any political headwinds it encounters.

    Why would the conservative judicial majority throw that all away on such a short-term, damaged, uncontrolled individual with a single-term 4 year shelf life even in the most rosy scenarios that he somehow wins the 2024 election?

  4. Hot take: they won’t and this is where Trump’s stupidity finally catches up to him. They don’t give a shit about Trump nor like him. Congress may have to act somewhat cozy but those judges don’t have to worry about MAGA voter opinions ever again.

  5. This could go a couple ways. In spite of finding the Conservatives on the court despicable as a rule, even I have to concede that they aren’t as likely to march in lockstep with the GOP like those in Congress. They’re not elected so down-ballot association with Trump isn’t a factor.

    Another thing I think should be acknowledged here is that a country fighting with itself is less economically productive. These judges probably know this as much as the wealthy backers who have started to drift towards Haley know it. With her, they can still have their long term Conservative goals without all the constant screeching. That alone is reason to at least speculate that they will not automatically excuse and protect Trump.

    On the other hand, a Conservative is such because he is afraid of progress and lacks the depth or thoughtfulness to respond to fear in any other way than lashing out with violence at that which makes him afraid. I’m personally not bold enough to predict how this will go.

  7. Conservative justices have no love for Trump. They will use him to get their agenda enacted, but they know a second Trump presidency weakens the power of SCOTUS. I think it safe to assume they will decide in favor of their own best interests.

The supreme court is fucked no matter what they rule so they’re probably going to do the least bad thing and (hopefully? please [prays] **please**?) preserve the constitution and rule against the orange marmot. If they don’t, they pretty much give Biden unilateral freedom to do anything he wants because the precedent will be set.

  9. The Confederates barred from office under the 14th were never charged and convicted. It was a matter of common knowledge that they were a part of the Confederacy. The facts were not in dispute.

    States are supposed to have an absolute right to how they conduct their elections including ballot eligibility and in that matter there can be no higher authority than the State Supreme Court.

    But I think SCOTUS will agree to hear the case on the basis that it constitutes voter disenfranchisement in a national election. I think they will rule that a conviction is required when the facts are in dispute.

    Trump will frame it as him defeating the deep state, and it will help him because everything in this timeline sucks.

    I’m not saying that I agree with any of this. It’s just my prediction about what’s going to happen.

    Trump owns the GOP. No one but him has any control. His ideas are not even close to 100% GOP. He has and will destroy any GOP that rises up against him. Put him in office and he will destroy the GOP .. and democracy. SCOTUS is not going to be safe either unless they do exactly what he wants.

    Right now they can end this. That would be the smartest thing they could do. Will they? I doubt it.

  16. I hope I’m wrong, but Trump is probably gonna escape all this. I have so little faith in SCOTUS. Clarence Thomas is going to write the reasoning for it and then will smile at the cameras with a double middle finger salute.

    The question is which outcome does more to preserve the power of the court.

    That’s the one they’ll choose.

    And there’s a non-zero chance the best outcome for the court is to remove a player who doesn’t respect the constitutional order (and the court’s power by extension) from the board.

  18. It’s not a question of what the court will do but rather a question of what the moneyed interests behind the conservative majority want. If Trump is given the opportunity to run and wins, will big business thrive in an open authoritarian regime? How much leverage will be left when Trump has absolute power to do as he pleases? A Dangerous dog can be useful if it’s leashed. A Dangerous dog can maul YOU if you let the leash snap.

SCOTUS has three Trump-related cases before it – 1) The Presidential immunity case on the grounds that he was performing his official duties as President at the time of January 6th and during the fake electors scheme, 2) the obstructing an official proceeding case which posits that you have to actually screw around with physical documents and that inciting a riot doesn’t count, and 3) the Colorado removal due to insurrection case.

    IANAL, but (1) is a slam dunk against Trump. There’s no universe where you convince 5 justices that Presidential Immunity for egregious crimes should be or is constitutional. If they did, Biden could have SCOTUS rounded up and shot and claim it was part of his Presidential duties, and it would be legal. SCOTUS would be neutering itself, and that is not going to happen. At a minimum, you’ve got three liberals and Roberts, and then Gorsuch or Kavanaugh.

    (2) is a little trickier, but I still think this goes against Trump. Maybe they’re able to wiggle out of it on procedural grounds, but even then that’s going to be a difficult sell.

    (3) is probably the easiest to overturn. The law is somewhat vague, and you could probably go with a presumption of innocence in the absence of a conviction and get Roberts to buy in.

    If SCOTUS delivers 5-4 or 6-3 decisions in the first two though, you’ll know the fix is in and they’ve gotten their marching orders to save Trump at any cost.

  24. What keeps getting glossed over is Trump tried(and failed) to subvert the 2020 election and the peaceful transition of power. This is not a definition of porno “I can’t explain it but I know it when I see it” situation this is a clear cut coordinated attack on the office of the president and the bed rock of democracy. Michael Luttig, a conservative and retired appellate judge of the U.S. Court of Appeals for the Fourth Circuit, called the opinion “unassailable under the objective law of the federal constitution and Section 3 of the 14th Amendment” given his three-year research and study of the issue alongside liberal Harvard Law professor emeritus Laurence Tribe — study that Luttig said took into account “every single argument contrary to every point made by the court today, including all of the contrary evidence to the opinion tonight.”

    “The Supreme Court of the United States ought to affirm this decision today,” Luttig said.

  35. It’s so fucked that the body ultimately responsible for ensuring this man sees justice has had 1/3 of its justices appointed by the same man. It’s beyond fucked. How is it even possible to put aside that bias in situations like these? I get that everyone has biases regardless, but come on. The guy who got you your job?   38. Several posterson the r/law forum stated that another Trump presidency would lessen the power of the Supreme Court, and that the Supreme Court would be unlikely to make a decision that could result in the reduction of their power.

  39. It doesn’t matter what the court rules. This court isn’t legitimate. The Supreme Court is corrupt, bought off, and biased. The foundation of the country has rotted out from under us.

  41. People seem to forget that if the Supreme Court finds that Trump had immunity… that means Biden doesn’t have to leave office. He can overturn the election with impunity because it has been decided that US Presidents are above the law. And I guess that means we can storm the Capitol as ordinary citizens engaged in legitimate political discourse in a peaceful tourist visit, right?
