I actually kind of expected this when the DC Circuit Court of Appeals stepped up and said they would take the case expedited. This is how the SCOTUS likes cases to come to them. The Appeals court is going to hear arguments on Jan 9. I’m sure they’ll rule pretty quickly, then we’ll see what happens. Yes, it’s going to end up at the SCOTUS either way, but on the face of it Trump is still in a weak, weak position. The concept that a President is absolutely immune to all criminal charges is not a President, that’s a king. And then Biden can do anything and be similarly absolutely immune.
Head over to r/law for additional insights. It might just be that they don’t want their “fingerprints” on this issue and will let the lower courts decide. When Trump then appeals the lower court decision, they’ll refuse to hear it and let the lower court determination stay and he’ll be toast.
