Trump is asking the D.C. Circuit Court of Appeals to reverse U.S. District Judge Tanya Chutkna’s decision to dismiss his immunity claims in the election subversion case led by special counsel Jack Smith. The appeals panel is considering Trump’s request, which the Supreme Court declined to expedite on Friday, as Smith requested.
When Trump urged a mob to storm the Capitol, he was aware that all courts had dismissed his claim that the election was invalid. His closest advisors told him the same thing and he “teamed up with cronies” to prevent a lawful transition of the presidency, Gershman said. Nothing Trump did to subvert the election was done as president. Everything he did was “outside the normal and routine acts” that presidents perform.
Consider the implications of a president engaging in actions taken to benefit himself personally, but having nothing to do with his role to “execute the laws of the United States.” If he shot someone on Fifth Avenue would he claim absolute immunity, Gershman questioned.
“While monarchs may claim absolute immunity, Trump was not king, however much he may have thought he was,” Gershman said. “If his unlawful, unconstitutional, and criminal behavior can be deemed official acts, then we must deem Trump to have been King of America. While his MAGA extremists might like that, that’s not how America works.”
I honestly think the district court is going to uphold Chutkin’s ruling and SCOTUS is going to deny cert again.

I thought this would be about the recent Amicus brief that was filed in this case by 5 top Republican legal scholars, who all say Trump has no immunity to violate the constitution, especially to overthrow the election.
He hasn’t lost until there is a real penalty. We’re learning all about the 2 tiered system. Name another American that wouldn’t be in jail already.
If Trump prevails in declaring that a president is immune from prosecution, even when attempting to interfere with an election, then Joe Biden should be perfectly all right in openly interfering with any attempt to re-elect Trump, right?
To me the fact that he is running with the immunity defense demonstrates that he and his cohorts aren’t even trying to claim he didn’t do it, just that doing it was somehow part of his duties as president and is therefore immune except for the fact that such an argument is flat out absurd by every conceivable measure.
But that’s the problem they have so convinced the base that the election was stolen that to them “it was his presidential duty to challenge and overturn the election” becomes reasonable to them because naturally if you entertain the stolen election claim it makes sense that they would think him doing everything in his power to remain in power even illegal things is justified because it was stolen.
What is insane though is that these people don’t realise that the opposite becomes true if the election wasn’t stolen which is simply that he was actually trying to steal it via multiple plans being executed including an attempted insurrection.
They have turned it into a zero sum game where for us to win they have to lose and for them to win we have to lose. Problem is if Trump or any other extreme right figure gains the power of a dictatorship in America in truth everyone loses.
If the Supremes take the case, and it’s a big if as they can just ignore it for as long as they like, they will desperately try to create a Trump only decision. Failing to do that, hopefully the fear of a Democrat president with immunity will prevent them from granting Trump the victory. Reading Thomas’ dissent should be entertaining at the very least.
If he’s immune then so I Biden. Biden can refuse to leave office as well. Which would definitely backfire on what he’s trying to claim.

Why can’t stupid claims be quickly and summarily dismissed by the courts? This fucker will tie up our legal system for years, and the legal system welcomes it.
