Studio hi Daniel uh tell us more what does this successful emergency appeal mean for Apple well of course it’s good news for Apple isn’t it it can now import watches into the US it’s Apple watch which of course is made abroad and it can sell them now again too now it

Had preemptively taken them off the shelves and stopped selling it in its own online store a few days ago so there was a period where absolutely was not selling watches in the US and JP Morgan uh the Investment Bank in in the US estimated that if this continued then

They could have lost up to5 Billion now that sounds a lot it is a lot but that’s only 1% of Apple’s annual revenue that it makes from selling its devices so um yeah it would have been a sting that’s for sure the the worst bit that comes

Out of this though is that it’s an kind of an own goal that usually you expect Apple to be able to get ahead of these kind of things and stop them before they happen so it would have been an unnecessary loss either way yeah take us back a step because this is quite

Unusual how did the dispute get to the point where the Apple watch was being taken off of shelves well mimo says that um its patented um blood oximeter technology that measures the oxygen levels in your blood is included in these watches now of course Apple disputes that it says that it hasn’t um

Infringed any kind of patent rights from Massimo but the US it C which is the International Trade Commission disagreed it says okay you that’s they imposed this ban essentially and you know you’d expect Apple would have seen all of its potential options on the table it could

Pay licensing fees to Mimo it could have settled over this particular dispute it could even just buy mimo entirely it has enough money it has well over $160 billion in cash just lying around behind the sofa so there’s plenty of options on the table but it didn’t do any of those

  1. This is a temporary pause on the ban pending appeal. Apple will lose the appeal & will have to pay Masimo even more.

  2. Absurd. Let's call it for what this really is. Apple stole the technology, thought they could get away with it, and then lost in court. The simple solution: pay a licensing fee to Masimo. Instead, Apple put up a BS argument that the sky was falling, the company would have to shut down, the world would tilt off axis another 5% and total calamity would ensue.
