Donald Trump set up for supreme court disappointment

  1. Is it possible the SC rules that Trump, and only Trump, has special immunity?

  2. My Supreme Court prediction for the Colorado case: Trump’s appeal will be allowed for any one or more of the following baloney reasons by his pet Supreme Court judges:

    (1) The disqualification doesn’t apply to the Presidency because the founders didn’t intend it to.

    (2) Even if the disqualification applies to the Presidency, the disqualification requires a conviction because the Presidency is the highest position in the land, so requires special treatment different from historial precedents.

    (3) Even if a conviction was not required, Trump did not take part in insurrection either on the facts (he was just “asking questions” or didn’t specifically call for insurrection), or on the law (an insurrection requires a total civil war not just trashing Congress).

    (4) Even if Trump took part in insurrection, the case was procedurally flawed because it was brought by the wrong plaintiff, brought too early/too late, there’s a missing comma in the court form, etc.

  5. Special Counsel Jack Smith, argued in a court filing that nothing in the U.S. Constitution or American legal tradition supports giving former presidents “absolute immunity” from criminal charges for action taken while in office.
    “Absolute Immunity” does not and never will apply to DJT… again, he’s only saying what he wants to believe.
    DJT’s not above the law… No one is above the law.

  7. Here’s the thing. The GOP wants to be rid of Trump and his cronies. For all the use he has been to them, they don’t have a good grasp on controlling him. This has cost them in elections recently. They are too scared to actually take action themselves but are not above letting others deal with him if necessary.

    While they have said they don’t like removing him from the ballot, notice they haven’t actually done anything to try and stop it from happening. All they’ve done is scream a little and make empty threats towards Biden.

    I think SCOTUS will just say it’s the states decision ultimately giving many states the chance to remove him without the GOP looking like the direct ones who did it. Then they can vilify dems and go back to their goal of stripping more basic rights from Americans but without Trump’s insanity looming over them.

The fact is is that the SCOTUS are really reluctant to get involved in this because of the fact that they don’t want to be seen as being too politicized or running the risk of death threats…and…well…people forget that just because the court is majority conservative doesn’t necessarily mean that they all agree on one issue or another.

    Thing is, my bet is that the SCOTUS will be more preferable to state courts like “Well guys, this shit is your problem to deal with, not ours.”

  16. Not a huge deal, really. This is just saying that it’s improper for Trump to make such an appeal until his court case is finished and a ruling made.

    This appeal from Trumps team is somewhat important, it’s just a delay tactic anyway.

    If there is a ruling before Trump can assume presidency and halt the entire prosecution, then he can appeal it.

  17. “Set up for” “may” “could” “might” “would be” – Is the bar for a few daily news headlines been lowered to the point where re-wrapping the same news with maybe one extra detail and a lot of speculation is good enough? It’s hard enough to keep up with all of the noise. Yeah – Trump whines and does everything he can to evade facing any responsibility. This isn’t news. Speculating on what the Supreme Court might do is pointless as well. They have a far right majority, so don’t be surprised if they go to bat for their team rather than their jobs. What will be newsworthy is if they don’t side with the prick in an official ruling. It’s been years of “BREAKING NEWS!!!! Trump may actually face consequences THIS TIME!!”

    FFS – enough. Report when something new and substantial happens. I don’t care if he shits in his adult diaper. Of all the things Trump, this isn’t even a blip on my radar with off of the actual important things surrounding this prick making his way into office again via the antiquated Electoral College.

  18. The conservative justices are all federalists, the federalists want Trump gone. Trump is done. I can see an 8-1 decision on this one with guess who dissenting.

  19. The former president makes the mistake of thinking because he nominated three people on the Supreme Court they should do what he wants that’s the problem he has because no one is above the law and the court has to go by the law

  22. The easiest solution for the SC would be to brush it off. “This is defined in the Constitution but the power is not reserved for the Federal government, therefore it is up to the States to decide.”

    That would be entirely on point, deflect the issue, and move on.

    Of course, I know Thomas and a few others want to retire in 2025, so…

  23. Part of me likes to think that the fact Trump is delaying going out scotus is because his team knows they won’t side with him. If he knew things were tilted in his favour he’d be happy to be declared immune

  24. This is a great trap set. As others mentioned, if immunity is granted to a president, or any citizen, then what keeps one from being a tyrant or being a king? They would prop one to be given even more power, to remove the ones “granting” the immunity. Makes no sense so no dollars.

    Similar to J6 insurrection success logic: stormed a government building and hung Pence. So what and now what? – that doesn’t give any power over the military, state’s citizens, healthcare, schools, or the economy. Thinking that occupying one building is control over a first world nation? Folks would go just go about life without paying taxes, to live the life they choose if there are no rules. Then what?

  25. DC Appeal will shut him down flat, but over and above the Asphalt case I hope they strongly reaffirm Trump isn’t a king. The public at large should understand that beyond procedural reasons of constitutional exclusion, the fundamental constitutional and criminal law principle, is that no one, including a President, is beyond the reach of the law. The most important part of this follows the Appeal decision: will the SC not take up an appeal or let the lower courts decisions stand? If they take up Trump is a King appeal, will they expedite the hearing so the DoJ trial can proceed before the Nov. 2024 election. If not, then very little justice remains in America.

  26. In a functioning judicial branch, Trump would be set up for absolute disappointment. In our current bought-and-paid-for SCOTUS? I’m not confident justice is on the menu.
