Hello guys, I’m having an issue with my landlord. I informed her via WhatsApp about wanting to move out of the house 5-6 days ago. She mentioned she would return on New Year’s Eve but she didn’t. Today, she called me and said I could leave the house no earlier than April 30, 2023, citing January as a ‘stichmonat’. However, the contract states I can leave after a notice period of 3 months following one year. I’ll attach a screenshot of that part of the contract. As far as I understand, I can leave on March 30, 2024, but the landlord insists it’s April 30, 2024. Who do you think is right here?

  1. 1 year is from 1.1.2023 until 1.1.2024.

    You can cancel after 1 year.

    Anything before 1.1.2024 is not “after 1 year”.

  3. Your 1 year ended at 31.12.2023. The contract says you can cancel AFTER 1 year is over. So the first possible date to cancel would be january 1st. The day you cancel doesn’t matter unfortunately, it always counts as you cancelled at the last of the month. In your case january 31th. Then add february, march and april as the three months notice.
