So last year landlord increased the utilities cost from 125 to 185 euros. So he told me that he got a new plan for 2024 and the prices has been increased and he asked me to start paying the 180 euros (2128,76/12) from November, 2023. My understanding is that if the payment plan is for 2024 then i should not have payed 180 for November and December. On the other hand I am attaching the utilities document that he shared with me and there I am confused like do I also have to pay the landlords insurance. If anybody could guide me then that would be helpful.

  1. Almost all costs your landlord has in regards to the building he rents out can and will be distributed to the tenants, yes (with some exceptions). This includes insurances and taxes

  2. yes, insurance costs can be put into the Nebenkosten. Even taxes can be put into Nebenkosten, which your landlord seems to not have done. The only thing that *might* be a bit strange is the cost for Heizung und Wasser. Im not sure if the division by square meter is okay or if the landlord would have to measure consumption and divide accordingly.

    Also, the landlord can increase Nebenkosten right after having sent you a Nebenkostenabrechnung. So if they sent it to you in October, they can ask you to pay the higher Nebenkosten from November on. I’m not sure if he would be allowed to ask for 180 Euro as 2128/12 is only 177 Euro, but in my opinion these 3 euro are peanuts that would not be worth fighting over.
