  2. Deciding nobody is above the law is mundane, the monumental thing would be agreeing he never took an oath of office because the Constitution calls it a presidential oath.

  3. This is good news for Biden anyway. Or presidents are immune, and Biden then can get rid of Trump without consequences. Or they are not immune, and Trump can not be chosen president again.

  4. They will come up with an excuse then say it is a one off excuse like in Bush v Gore and cannot be used as an excuse from then on.

    I think it would be funny to use their hypocrisy against them and have several Democratic leaning states place Obama on a ballot for a third term.

    btw the excuse they will use is Equal Protection Clause of the 14th Amendment.

    It is the excuse they used to rule in favor of Bush. Saying that he was harmed under the 14th Amendment. Except in the case it was the voters who were harmed by not allowing the recounts to continue.

    But it’s anyone’s guess if they’re going to stick with their own precedent.

    I think they’ll leave him on the ballot; even trying to destroy the country can’t get you disqualified from future elections.

  9. having read about this a ton. I think they’re gonna say “It’s up to congress to determine the process for finding someone culpable of insurrection, every state can’t use a different process and definition.” it absolves them of any responsibility while giving Trump a free pass.

    one thing that’s absolutely clear is that they’re not going to make an evaluation of whether or not trump committed an insurrection.

    I also think it’s unlikely that a conservative court of originalists is going to define a standard like “must be criminally convicted in a federal court” which was very obviously not the intent when the 14th was written.

    edit: the diversity of solid explanations in the replies make my point better than I ever could. the fact that we can debate “well colorado didn’t feel federal conviction of insurrection was necessary” and “other states say it is necessary” and others can say “well, there was an impeachment hearing and he wasn’t removed” and some courts are saying “well, it all applies, but he technically isn’t an officer” all points to an environment where there isn’t enough legal clarity on what the process is.

  15. It’s just so amazing to me how much people want to make exceptions just for Donald Trump, a selfish, ugly, churlish man with the intellect of a psychotic stegosaurus and the morality of a trash-tier comic book supervillain.

    And it’s amazing how conflicted they are when they have to hold him accountable to the same rules as everyone else.

    And it will be amazing to see how the Supreme Court manages to interpret the constitution so that it applies to the president but it doesn’t apply to Donald Trump.

  17. Every choice is a double edged sword. Any allowance they give Trump or Republicans is the same allowance they give Biden or Democrats. This exact behavior by Republicans have backfired in Republicans faces several times in the past. There is good reason why the Supreme Court is supposed to be non biased towards any political party or personal biases. Every single bias is a new double edged sword that both parties or any individual can exploit.
