  3. Figure it this way. Trump is screwed regardless based on this example. Either presidents are not immune, or Joe Biden is going to call up Seal Team 6 and take him out. Anything that Trump gets away with, Biden does too.

  4. I bet someone at Team Trump is wondering who blabbed about their plan to have Special Forces assassinate Trump’s political rivals if he becomes President again.

  5. Trump’s lawyer eviscerated Trump’s planned defense for his criminal trial by saying impeachment can (and should) be followed by a criminal proceeding for the same crime. Trump’s team previously adopted the opposite position on this question, when they said any criminal proceeding is unconstitutional double jeopardy since he already had an impeachment proceeding launched against him for the insurrection.

  6. So, according to this argument, Biden is free to have Trump assassinated. So long as the Senate does not convict him (controlled by Dems), then Biden could rid the world of the Trump freak show forever? That seems to be what Trump’s lawyers are arguing in court.

    The lawyer made an argument about the framers definitely not wanting factions of government but then relies on the argument that impeachment by the Senate would clear any ambiguities of crimes during presidential duty but ignores the fact we had exactly that…. a “faction” who ruled not to impeach because they were complicit….a faction.

  9. They said the only way a president can be tried criminally is if they are impeached by the House and convicted by the Senate. So if Trump had killed a prostitute with his bare hands and drug her corpse through the Oval Office, and republicans refused to find him guilty, then at no point in his life can he be criminally charged with murder.

  11. The question that the judges should have posed to Trump’s counsel is whether POTUS is immune from prosecution for ordering the assassination of Trump’s counsel and of every GOP Senator that would vote to remove POTUS from office.

  12. What stops Seal Team Six from assassinating the average citizen who might have a large following, say, on national TV or social media from criticizing him? If they go after rivals, they’ll go after “you” as well.

    And he’d respond “It’s a qualified yes – because he could if he were impeached first”

    And this went back and forth like 5 times

  32. The POTUS who orders the assassination of their political rival wouldn’t just sit back and allow Congress to impeach them if they’d only be criminally liable for subsequent impeachment and removal via Congress.

    I can’t believe this is an actual argument being made by anyone save some sovereign citizen loon.

    POTUS immunity invalidates the entire U.S. Constitution.

    In Trump’s lawyers mind, what happens if a president has their successor assassinated after losing reelection?

    Say this assassination happens the day before the next president is sworn in.

  35. So let’s play this out. Biden whacks Trump and his kids and Bannon and Stone just for shits and giggles.

    Then they take out Johnson so there’s no speaker of the house to call for an impeachment.

    As soon as another speaker is voted in they get taken out.

    And so on and so on. So no impeachment can ever be put into motion.

    That’s the argument Trump’s lawyer is making.

  36. Seems like a risky argument for someone who is not the current sitting president. Kinda opens the doors for the current sitting president to eliminate rivals as well under this argument.
