Food product developer here… This is way out of spec. There’s an ungodly amount of statistical analysis goes into this, but here’s the basics
The “e” symbol for a 400g product means the acceptable error (TNE) is 3% (it is a different size or % for different weight or volume products)
It is accepted that 2.5% of products can be below the TNE of 3%, but that zero products should be below 2 TNEs of error, 6% .
– 1 TNE for 400g E is 388g so “unlucky” means a 1 in 40 chance.
– 2 TNE for 400g E is 376g so receiving less than this is a defective product and should be reported to trading standards.
– 3 TNE is 9% or 364g which you have, which is unacceptable.
In packaging, if a product has such a large variation between weights then it is necessary to increase the average portion to ensure none fall below 2 TNE.

The fact this is vacuum sealed means there hasn’t been anything like water loss.

As someone who has worked in a similar area (production of consumable goods),, trading standrads let us know that 10% was considered an allowable error of estimation when packaging and preparing goods for consumption.. This is supposed to be because of natural differences in products etc, but the reality is that if the machine in the factory can operate with enough accuracy, they’ll stiff you out of 9.5% every single time. Our product was supplied in a 10ml bottle,, there was just over 9ml in every single one.
It’s called rounding up the numbers 🔢
