  1. Shouldn’t this be decided by elected representatives who create law? If it’s being decided by unelected judges, they can only apply law as currently written.

  2. It’ll be interesting to see how this could be applied to the legal definition of Men and, as a result, f to m transition.

  3. 2025 and we’re defining women, not trying to stop wars or climate change or poverty or anything that could make this miserable existence any more pleasant but trying to work out what a woman is.

  5. We could just go off the biological definition, it’s worked so far. Otherwise we are going to end up with trans women in Male prisons, and perhaps health services coming up with new terms for biological male & female and recording that on a patient’s medical record.

    Maybe it’s better if they just come up with legal definitions for trans men and trans women instead.

  6. Sensationalist headline.

    What is actually being rule on whether, for the purposes of law, is whether what is considered to be sex as defined under the Gender Recognition Act in Scotland (i.e. a legal definition) is in breach of the Equality Act. The Supreme Court will not define what it means to be a woman. It does not have the power to do that. It can only rule on an interpretation of the law.

  8. For the biological/chromosome crowd….. try this: Define mother.

    Easy. Biological fact, right? Did the kid grow in your womb?

    So if my wife and I adopt a kid, is she the mother? Biologically, no. Legally, yes. Socially, yes. For all intents and purposes outside of hereditary medicine, yes.

    Biological and legal motherhood are different things. The legal status can be changed, and needs to in certain situations to let you fulfil your role in society.

    Botanically, it’s a fruit.

    Culinary, treated as a vegetable, much like cucumbers.

    The word ‘fruit’ being used in two realms, causing confusion or a contradiction.

    In this case, ‘woman’ when looking at the world through sex, or genetics, is an adult female.

    But in the world of gender (which was always used as a synonym for sex, out of politeness) it can mean ‘identity’, or how someone perceives themselves.

    Again, one word, ‘woman’ in two paradigms. Only this time woven into law.

    Laws that were written at the time with the former in mind, where people now of the latter, want in on it.

    I coming at this from the average person’s perspective who is not well versed in the terminology.

  16. The current state of thinking seems to be that if you feel like a woman, and want to be a woman then you can be a woman. Even if you’re a man. If you’re white but feel like you’re not though, that’s appropriation and horribly racist.

    Surely the logical definition is that if you were born a woman, you’re a woman. If you weren’t but feel like one, then you simply identify as one but you’re still a man. For the extremely rare medical cases where it might be unclear, then it’s up to a doctor to decide.
