The man who was run over in the parking lot of Bentley’s Tavern has succumbed to his injuries.
The man who was hit in the parking lot of a bar and restaurant in the town of Malta has succumbed to his injuries.
The attorney for the family of Joshua Soden, said that he has been declared brain dead.
“He was fighting very hard for over a week at Albany Med, and he has succumbed to his injuries,” said Ryan Finn.
Soden was hit and pinned under a car in the parking lot of Bentley’s Tavern on Sept. 8.
Morgan Lange, of Glenville, is facing charges of driving while intoxicated and vehicular assault. Police said she had a blood alcohol concentration of 0.12% and also allegedly tried to dispose of an alcoholic beverage that was in the vehicle.
Finn said he expects that the charges will be increased to vehicular manslaughter.
“We believe that certainly those charges are justified under the circumstances,” he said. “We also will be bringing a wrongful death lawsuit, certainly against Bentley’s, certainly against the driver of the vehicle and any other one else who is deemed to be responsible.”

The family is donating Soden’s organs. The GoFundMe page set up for his medical expenses will go to funeral expenses.
It has raised more than $40,000.
