Swindon Borough Council will bring the prosecution of Clearsprings Ready Homes for 39 alleged breaches of housing law in relation to houses of multiple occupation.
The case will be heard at Bristol Magistrates’ Court in mid-January next year.

There are 39 separate charges made by the council against the housing company.
The council alleges Clearsprings Ready Homes “failed to comply with regulations in respect of management of housing in multiple occupation” 27 times between May and October 2022, and there are two allegations that it did not respond to a housing notice when it failed to produce documents when required by the council.
Specific allegations include: failing to ensure fire doors in properties closed properly, failing to ensure a bedroom could be opened from inside the room, failure to ensure adequate drainage in communal bathrooms, failure to ensure that smoke alarms and other safety measures were working, and failure to deal with an uncontrolled water leak.
The allegations concern five different properties across Swindon.
There are also six charges that the holder of the licence necessary to operate an HMO did not comply with the licence conditions.
There are also four charges that an employee of the company “knowingly or recklessly supplied false or misleading information to a housing authority” when they did not disclose to the borough council that they had been convicted of a previous housing offices.
These failures are alleged to have taken place between August 9 and 14 in 2022.
The case can go ahead in the new year after the Divisional Court found against Clearsprings application for the overturning of the decision of a district judge who refused to dismiss the council’s claims against the company.
A report on that specific aspect of the case made by the council’s barriers at Garden Court Chamber in London suggests the council considers the case to be “of significant public importance concerning the enforcement of housing standards in Houses of Multiple Occupation.
Both Swindon Borough Council and Clearsprings Ready Homes have been approached for comment.
