PHOTO | COURTESY<\/p>\n<p> <img decoding=\"async\" data-v-7257c9c5=\"\" src=\"https:\/\/www.europesays.com\/africa\/wp-content\/uploads\/2026\/01\/tts-pre-loader.gif\" alt=\"Vocalize Pre-Player Loader\" style=\"all:unset!important;display:inline!important;\"\/> <\/p>\n<p data-v-7257c9c5=\"\" style=\"font-size:13px;margin-left:20px;\">Audio By Vocalize<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Amnesty<br \/>\nInternational Kenya Executive Director Irungu Houghton has formally resigned<br \/>\nfrom President William Ruto\u2019s Panel of Experts on Compensation of Victims of<br \/>\nProtests and Riots with immediate effect, lamenting what he describes as a material<br \/>\nalteration of the legal basis for the panel\u2019s continued existence.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Houghton\u2019s<br \/>\ndecision, communicated in a letter to Prof. Makau Mutua &#8211; chairperson of the<br \/>\npanel &#8211; on Friday, follows President Ruto\u2019s January 5, 2026 extension of the<br \/>\npanel\u2019s mandate by 180 days.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">This<br \/>\ndespite a December 4, 2025 ruling by the Kerugoya High Court that declared the<br \/>\npanel unconstitutional and affirmed that compensation for human rights<br \/>\nviolations properly resides with the Kenya National Commission on Human Rights<br \/>\n(KNCHR). <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">In<br \/>\nhis resignation letter, Houghton reflects the constitutional tension that has<br \/>\ndogged the panel since its formation.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">\u201cI<br \/>\nwrite to formally tender my resignation from the Panel of Experts with<br \/>\nimmediate effect. My decision follows the President\u2019s 5 January 2026 extension<br \/>\nof the Panel\u2019s mandate for a further 180 days despite the 4 December 2025<br \/>\nruling of the Kerugoya High Court,\u201d he stated.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">He<br \/>\nargues that the High Court\u2019s decision \u201cmaterially alters both the legal basis<br \/>\nand institutional legitimacy of the Panel\u2019s continued existence. As a<br \/>\nconstitutionalist, I am obligated to respect judicial determinations and act in<br \/>\na manner that safeguards the integrity of independent institutions.\u201d <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Houghton\u2019s<br \/>\nresignation is the culmination of developments that began in September 2025,<br \/>\nwhen he <a href=\"https:\/\/www.citizen.digital\/article\/rights-defender-irungu-houghton-suspends-role-in-rutos-protest-victims-panel-n369488\" target=\"_blank\" rel=\"nofollow noopener\">suspended his participation in the panel<\/a> after the High Court<br \/>\ntemporarily halted its operations pending a legal challenge to its<br \/>\nconstitutional standing.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">At<br \/>\nthat time, he stated: \u201cFor the avoidance of any public doubt, I immediately<br \/>\nsuspended my participation in the Panel of Experts &#8230; in accordance with<br \/>\nMonday\u2019s order by the High Court and my respect for the rule of law,<br \/>\nconstitution and judicial oversight.\u201d <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">At<br \/>\nthe time of that suspension, Houghton made it clear that he had not<br \/>\nparticipated in any panel meetings beyond the swearing-in and would refrain<br \/>\nfrom duties until the court provided a pathway forward. <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Houghton<br \/>\nfurther disavowed an application filed on December 15, 2025, seeking to stay<br \/>\nthe High Court\u2019s ruling, saying his name had been erroneously included without<br \/>\nhis consent or consultation. <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">\u201cI<br \/>\nwas neither consulted nor do I support the December 15 application to stay the<br \/>\ncourt ruling,\u201d he wrote, adding that he \u201cdid not enter appearance when listed<br \/>\nas an interested party.\u201d <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">He<br \/>\nalso referenced his own public commentary from December 6, 2025 where he urged<br \/>\nfull compliance with the court\u2019s determination that KNCHR, not a presidential<br \/>\npanel, should lead compensation efforts. <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Despite<br \/>\nhis departure, Houghton took pains to underscore his ongoing solidarity with<br \/>\nvictims of state violence.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">\u201cI<br \/>\nremain grateful for the opportunity to explore this avenue for truth, justice<br \/>\nand compensation for victims of state violence while expressing their<br \/>\nconstitutional right to assembly. The victims\u2019 families\u2019 cry for<br \/>\naccountability, justice, and reparations has anchored my personal conscience<br \/>\nthroughout this journey,\u201d he said.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">But<br \/>\nhe insisted that fidelity to the Constitution, the rule of law and<br \/>\ninstitutional accountability must take precedence over expediency; a stance<br \/>\nthat, in his view, now lies outside the panel\u2019s current legal footing.<\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">Houghton<br \/>\nconcluded by urging all stakeholders to remain unwavering in pursuit of justice<br \/>\nin coherence with the Constitution and the recent court judgment. <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">The<br \/>\n<a href=\"https:\/\/www.citizen.digital\/article\/panel-of-experts-to-oversee-compensation-of-protest-victims-sworn-in-n369074\" target=\"_blank\" rel=\"nofollow noopener\">panel was sworn in<\/a> September 2025 to advise the Presidency on reparations for<br \/>\nvictims of protests and demonstrations, including police brutality incidents<br \/>\nstretching back years. <\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt:auto;mso-margin-bottom-alt:auto;&#10;line-height:normal\">However,<br \/>\nits work was mired in constitutional challenges almost from inception.
