{"id":18680,"date":"2026-01-12T11:50:53","date_gmt":"2026-01-12T11:50:53","guid":{"rendered":"https:\/\/www.europesays.com\/africa\/18680\/"},"modified":"2026-01-12T11:50:53","modified_gmt":"2026-01-12T11:50:53","slug":"zimbabwe-rights-activists-acquitted-after-year-long-trial","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/africa\/18680\/","title":{"rendered":"Zimbabwe: Rights Activists Acquitted After Year-Long Trial"},"content":{"rendered":"<p>(Johannesburg) \u2013 A\u00a0<a href=\"https:\/\/www.hrw.org\/africa\/zimbabwe\" rel=\"nofollow noopener\" target=\"_blank\">Zimbabwe<\/a> court\u2019s acquittal of three human rights activists on disorderly conduct charges more than a year after their arrest highlights the authorities\u2019 misuse of the criminal justice system against dissidents, Human Rights Watch said today. Zimbabwean authorities should end politically motivated arrests and prosecutions of human rights defenders, activists, and journalists.<\/p>\n<p>On August 21, 2025, a Harare Magistrates Court\u00a0<a href=\"https:\/\/www.newzimbabwe.com\/human-rights-defenders-acquitted-after-year-long-trial\/\" rel=\"nofollow noopener\" target=\"_blank\">acquitted<\/a> the human rights activists Robson Chere, 41, Namatai Kwekweza, 26, and Samuel Gwenzi, 40. On July 31, 2024, state agents had pulled the three off a plane before takeoff at Harare\u2019s international airport and\u00a0<a href=\"https:\/\/www.omct.org\/en\/resources\/urgent-interventions\/zimbabwe-arbitrary-detention-and-alleged-torture-of-namatai-kwekweza-robson-chere-and-samuel-gwenzi\" rel=\"nofollow noopener\" target=\"_blank\">held them incommunicado<\/a> for nearly eight hours. The arrests appeared to be part of an\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2024\/07\/08\/zimbabwe-sadc-should-respond-intensified-crackdown-opponents\" rel=\"nofollow noopener\" target=\"_blank\">intensified crackdown<\/a> on opposition and civil society groups ahead of the Southern African Development Community Summit of Heads of State and Government in Harare in August 2024.<\/p>\n<p>\u201cThe baseless prosecution of the three human rights activists shed a spotlight on unjust arrests, mistreatment, and politically motivated trials in Zimbabwe,\u201d said\u00a0<a href=\"https:\/\/www.hrw.org\/about\/people\/idriss-nassah\" rel=\"nofollow noopener\" target=\"_blank\">Idriss Ali Nassah<\/a>, senior Africa Researcher at Human Rights Watch. \u201cIt shouldn\u2019t have taken a year for the defendants to be acquitted, such cases need to end.\u201d<\/p>\n<p>The police had\u00a0<a href=\"https:\/\/www.newzimbabwe.com\/human-rights-defenders-acquitted-after-year-long-trial\/\" rel=\"nofollow noopener\" target=\"_blank\">charged<\/a> them with participating in an illegal protest outside the Harare Magistrates Court in June 2024.\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/08\/zimbabwe-must-release-human-rights-defenders-ahead-sadc-summit-say-experts\" rel=\"nofollow noopener\" target=\"_blank\">United Nations special rapporteurs<\/a> described the charges against the three activists as \u201cbaseless\u201d and of \u201cbeing used as a fig-leaf to target human rights defenders and opposition voices for calling for greater democracy, human rights and accountability in Zimbabwe.\u201d<\/p>\n<p>Initially, a Harare magistrate\u00a0<a href=\"https:\/\/trt.global\/afrika-english\/article\/18196673\" rel=\"nofollow noopener\" target=\"_blank\">denied the three bail<\/a>, ruling that they were likely to abscond or commit other offenses, and that their release might undermine delivery of justice. In September 2024, the High Court\u00a0<a href=\"https:\/\/www.zimlive.com\/kwekweza-chere-and-gwenzi-granted-bail-by-high-court-after-35-days\/\" rel=\"nofollow noopener\" target=\"_blank\">granted them bail<\/a> after they had spent 35 days in detention.<\/p>\n<p>The trial began on September 5. The prosecution continued with the proceedings for nearly a year, even after Kwekweza demonstrated that her passport showed that she was\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/08\/zimbabwe-must-release-human-rights-defenders-ahead-sadc-summit-say-experts\" rel=\"nofollow noopener\" target=\"_blank\">not even in the country<\/a> when the alleged offense occurred.<\/p>\n<p>At the trial, the activists\u2019 lawyers documented evidence of\u00a0<a href=\"https:\/\/www.zimlive.com\/4-pro-democracy-activists-seized-from-plane-tortured-in-airport-building-lawyers\/\" rel=\"nofollow noopener\" target=\"_blank\">torture and other ill-treatment<\/a>. Chere, who leads a teachers\u2019 union, had\u00a0<a href=\"https:\/\/www.bbc.com\/news\/articles\/cm2n5rg63r6o\" rel=\"nofollow noopener\" target=\"_blank\">bloodstained clothes<\/a> and limped in pain during his first court appearance after the arrest.\u00a0<a href=\"https:\/\/srdefenders.org\/zimbabwe-enforced-disappearance-cruel-treatment-arbitrary-detention-and-judicial-prosecution-of-namatai-kwekweza-robson-chere-and-samuel-gwenzi-joint-communication\/\" rel=\"nofollow noopener\" target=\"_blank\">Doctors<\/a> determined that Chere had suffered extensive soft tissue injuries and was in urgent need of treatment to prevent permanent kidney damage. Gwenzi, a member of a local council and a human rights activist, said his interrogators had assaulted him and\u00a0<a href=\"https:\/\/www.bbc.com\/news\/articles\/cm2n5rg63r6o\" rel=\"nofollow noopener\" target=\"_blank\">threatened to harm<\/a> his family.<\/p>\n<p>The administration of President Emmerson Mnangagwa, who took power in a military coup in 2017, has committed\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2023\/11\/15\/zimbabwe-joint-statement-calling-authorities-investigate-escalation-abductions\" rel=\"nofollow noopener\" target=\"_blank\">serious human rights violations<\/a> and has failed to institute promised reforms to improve respect for human rights, democracy, and the rule of law, Human Rights Watch said. The authorities have\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2023\/11\/15\/zimbabwe-joint-statement-calling-authorities-investigate-escalation-abductions\" rel=\"nofollow noopener\" target=\"_blank\">arbitrarily arrested and prosecuted<\/a> critics of the government on baseless charges.<\/p>\n<p>Violence, intimidation, harassment, and repression\u00a0<a href=\"https:\/\/www.hrw.org\/news\/2024\/08\/09\/zimbabwe-end-massive-crackdown-dissent-sadc-summit\" rel=\"nofollow noopener\" target=\"_blank\">aimed principally at political opposition members<\/a> and civil society activists have restricted civic and political space. Many of those arrested have been denied basic due process, including the presumption of innocence and the right to bail.<\/p>\n<p>\u201cEven as I celebrate a court victory, it is still only half a victory because the system remains unchanged,\u201d Kwekweza said in a\u00a0<a href=\"https:\/\/x.com\/namataik_\/status\/1958883858742403547\" rel=\"nofollow\">statement<\/a> after the acquittal. \u201cWithout accountability, my acquittal remains only half a victory. There are many others still facing judicial persecution appearing in court for crimes they did not commit\u2026. There are many more who have been convicted in political trials, abducted, tortured, and silenced.\u201d<\/p>\n<p>Zimbabwe\u2019s\u00a0<a href=\"https:\/\/www.veritaszim.net\/node\/4750\" target=\"_blank\" rel=\"nofollow noopener\">Constitution<\/a>, as well as the\u00a0<a href=\"https:\/\/www.african-court.org\/wpafc\/wp-content\/uploads\/2020\/04\/AFRICAN-BANJUL-CHARTER-ON-HUMAN-AND-PEOPLES-RIGHTS.pdf\" target=\"_blank\" rel=\"nofollow noopener\">African Charter on Human and Peoples\u2019 Rights<\/a> and the\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/international-covenant-civil-and-political-rights\" target=\"_blank\" rel=\"nofollow noopener\">International Covenant on Civil and Political Rights<\/a>, both of which Zimbabwe has ratified, protect the rights to freedom of association and expression.
