Unsplash\/Keith Kasaija\n            <\/p>\n<p>The proceedings, held at the Peace Palace in The Hague, mark the start of the merits phase in the case, after years of preliminary legal arguments.<\/p>\n<p>Over the next three weeks, <a data-extlink=\"\" href=\"https:\/\/www.icj-cij.org\/\" rel=\"noopener noreferrer nofollow\" target=\"_blank\" title=\"(opens in a new window)\">ICJ<\/a> judges will hear oral arguments from both sides, examine witnesses and experts, and consider whether Myanmar breached its obligations under the <a href=\"https:\/\/treaties.un.org\/pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=IV-1&amp;chapter=4\" target=\"_blank\" rel=\"nofollow noopener\">Convention on the Prevention and Punishment of the Crime of Genocide<\/a>, to which the country is a <a href=\"https:\/\/treaties.un.org\/pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=IV-1&amp;chapter=4\" target=\"_blank\" rel=\"nofollow noopener\">party<\/a>.<\/p>\n<p>Opening the hearings, Judge Iwasawa Yuji, President of the Court, outlined a detailed schedule that includes <a data-extlink=\"\" href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/178\/178-20251219-pre-01-00-en.pdf\" rel=\"noopener noreferrer nofollow\" target=\"_blank\" title=\"(opens in a new window)\">two rounds<\/a> of pleadings by Gambia and Myanmar, as well as closed sessions to hear testimony from witnesses called by the applicant State.<\/p>\n<p>Get the latest news<br \/>\n                <br class=\"br-line\"\/><br \/>\n                delivered to your inbox<\/p>\n<p>Sign up for The Manila Times newsletters<\/p>\n<p>            By signing up with an email address, I acknowledge that I have read and agree to the <a href=\"https:\/\/www.manilatimes.net\/terms-of-service\" title=\"Terms of Service\" rel=\"nofollow noopener\" target=\"_blank\">Terms of Service<\/a> and <a href=\"https:\/\/www.manilatimes.net\/privacy-policy\" title=\"Privacy Policy\" rel=\"nofollow noopener\" target=\"_blank\">Privacy Policy<\/a>.<\/p>\n<p>Speaking on behalf of Gambia, Attorney General and Minister of Justice Dawda Jallow told the court that his country brought the case \u201cafter reviewing credible reports of the most brutal and vicious violations imaginable\u201d committed against the Rohingya, a Muslim minority in Myanmar\u2019s Rakhine province.<\/p>\n<p>\u201cBy all measures, this case is not about esoteric issues of international law,\u201d Mr. Jallow said. \u201cIt is about real people, real stories, and a real group of human beings.\u201d<\/p>\n<p>A case years in the making<\/p>\n<p>Gambia filed its application in November 2019, accusing Myanmar of breaching the Genocide Convention through acts allegedly committed during so-called \u201cclearance operations\u201d carried out by the Myanmar military, or Tatmadaw.<\/p>\n<p>Those operations escalated sharply in 2017, prompting more than 700,000 Rohingya to flee to neighbouring Bangladesh amid widespread killings, sexual violence, village burnings and other abuses. Zeid Ra\u2019ad al-Hussein, the then UN High Commissioner for Human Rights, described the situation as a \u201c<a href=\"https:\/\/news.un.org\/en\/story\/2017\/09\/564622-un-human-rights-chief-points-textbook-example-ethnic-cleansing-myanmar\" rel=\"nofollow noopener\" target=\"_blank\">textbook example of ethnic cleansing<\/a>.\u201d<\/p>\n<p>A UN <a data-extlink=\"\" href=\"https:\/\/www.ohchr.org\/EN\/HRBodies\/HRC\/Pages\/Home.aspx\" rel=\"noopener noreferrer nofollow\" target=\"_blank\" title=\"(opens in a new window)\">Human Rights Council<\/a>-mandated fact-finding mission <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/39\/64\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a> in 2018 that it had <a href=\"https:\/\/news.un.org\/en\/story\/2018\/08\/1017802\" rel=\"nofollow noopener\" target=\"_blank\">reasonable grounds to conclude that serious crimes under international law<\/a>, including genocide, crimes against humanity and war crimes, had been committed.<\/p>\n<p>Nearly one million Rohingya remain living as refugees in camps in Bangladesh, while countless others are displaced or trapped inside Myanmar in dire conditions.<\/p>\n<p>Provisional measures<\/p>\n<p>In January 2020, the Court <a href=\"https:\/\/news.un.org\/en\/story\/2020\/01\/1055841\" rel=\"nofollow noopener\" target=\"_blank\">unanimously ordered provisional measures<\/a>, directing Myanmar to take all steps within its power to prevent genocidal acts against the Rohingya, preserve evidence, and report regularly to the Court on its compliance.<\/p>\n<p>Myanmar challenged the Court\u2019s jurisdiction, but in July 2022 the judges ruled that they were competent to hear the case.<\/p>\n<p>Eleven States also made written submissions in support of Gambia\u2019s interpretation of the Genocide Convention.<\/p>\n","protected":false},"excerpt":{"rendered":"Public hearings opened on Monday at the International Court of Justice (ICJ) in a landmark case brought by&hellip;\n","protected":false},"author":2,"featured_media":20685,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[58],"tags":[12871,5283,1613,12869,12872,12107,2398,2650,96,6050,12870,153,12873,1043,929],"class_list":{"0":"post-20684","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-uganda","8":"tag-aleppo","9":"tag-and","10":"tag-bank","11":"tag-brief","12":"tag-continues","13":"tag-fighting","14":"tag-gaza","15":"tag-in","16":"tag-news","17":"tag-repression","18":"tag-syrias","19":"tag-uganda","20":"tag-updates","21":"tag-west","22":"tag-world"},"share_on_mastodon":{"url":"","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/posts\/20684","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/comments?post=20684"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/posts\/20684\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/media\/20685"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/media?parent=20684"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/categories?post=20684"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/africa\/wp-json\/wp\/v2\/tags?post=20684"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
